RESOLUTION NO. 2014-003
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION THE 20-FOOT PUBLIC
SERVICE EASEMENT CREATED BY THE MAP OF STONE RIDGE
ESTATES, S-6-88, RECORDED IN BOOK 19 OF MAPS AT PAGE 3,
SHASTA COUNTY RECORDS, ON PROPERTY AT 3530 FOOTHILL
BOULEVARD (A-2013-01205)
WHEREAS:
A. The portion of a 20-foot public-service easement being considered for summary
vacation was created by the map of Stone Ridge Estates, S-6-88, recorded in Book 19 of Maps at
Page 3, Shasta County Records, on property at 3530 Foothill Boulevard.
B. The owners of the property have asked that the City vacate the portion of a 20-foot
public-service easement as described in Exhibit A and shown hatched on Exhibit B, attached and
made a part hereof by reference, since it has not been used for the purpose for which it was
dedicated or acquired within the last five years.
C. The Engineering Division of the Public Work Department has advised the City
Council that there are no in-place public facilities that are in use or would be affected by the
proposed vacation, and that portion of a 20-foot public-service easement, as described in Exhibit
A, and shown hatched on Exhibit B, is no longer required for public use.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California O
Streets and Highways Code, Section 8333.

2. The City Council approves the request to summarily vacate that portion of a 20-foot O

public-service easement, described in Exhibit A and shown hatched on Exhibit B.

3. The portion of a 20-foot public-service easement being vacated has never been used for
the purpose for which it was dedicated, is no longer needed for public-utility purposes,
and is not required, and there are no public facilities that are affected by this vacation.
Therefore, from and after the date this resolution is recorded, that portion a 20-foot
public-service easement, as described in Exhibit A and shown hatched oil Exhibit B, shall
be vacated in its entirety and will no longer constitute a public-service easement.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
at a regular meeting of the City Council on the 7`h day of January, 2014, by the following vote:
