Home My WebLink AboutReso 2012-054 - Sundial Bridge DriveG 111111111I111111111111I1111I111111I11111111 Nr 2012-0020599 Recorded I REC FEE 0.00 Official Records I County of I Shasta I Les 1 i e Morgan I Assessor -Recorder I I I PM 08:19AM 27-Jun-2012 I Page 1 of 6 ~ RECORDING REQUESTED BY: City of Redding WHEN RECORDED RETURN TO: City Clerk City of Redding 777 Cypress Avenue Redding CA 96001 RESOLUTION NO. 2012-054 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING, DEDICATING CERTAIN CITY OWNED AND REDDING JOINT POWERS FINANCING AUTHORITY OWNED PROPERTY KNOWN AS SUNDIAL BRIDGE DRIVE (FORMERLY KNOWN AS AUDITORIUM DRIVE) FOR PUBLIC STREET AND UTILITY PURPOSES WHEREAS, effective January 12,2012, the City began a long term lease with Advance Redding as tenant for use of the Redding Joint Powers Financing Authority (JP A) owned property, formerly known as the Redding Convention Center; and, WHEREAS, Ground Lease (C-2902) dated January 7, 1992 between the City of Redding, California and the Turtle Bay Exploration Park, formerly known as Alliance of Redding Museums was amended on June 30, 2010 to clarify the ability of Turtle Bay Exploration Park to finance and construct a hotel and necessary improvements on a potion of said Ground Lease; and, WHEREAS, due to the increase in intensity of use and the number of parties in exclusive possession and control of property under the ownership of the City and/or IP A, the City desires to formally dedicate as public right of way certain areas of the property historically used by the public for access and for utilities to property being leased; and, WHEREAS, Redding Municipal Code section 13.04.010 recognizes the authorityoftheCity of Redding to formally declare and dedicate as public right of way any property "dedicated to the use of the public by the owner of the soil and used by the public; and WHEREAS, the City of Redding as owner of the property subject to the Ground Lease deems it to be in the public's best interest to formally dedicate Sundial Bridge Drive as a public right of way; and WHEREAS, the City of Redding as lessee of the IPA property (Facilities Lease executed on December 15,2004 and recorded on December 15, 2004 and Instrument No 2004-0071635) also deems it to be in the public's best interest to formally dedicate Sundial Bridge Drive as a public right of way; and, ~ ~ () ......... ~ I () U\ --t... WHEREAS, the portion land to be dedicated for public street and utility purposes are described in Exhibit "A" and shown on Exhibit "B," which are attached and incorporated in this Resolution. NOW, THEREFORE, IT IS HEREBY RESOL YED by the City Council of the City of Redding as follows: 1. That certain portions of City owned property and JP A owned property described in attached Exhibit IIAII and shown on attached Exhibit "BII are hereby dedicated as an easement and right-of-way for public street and public utility purposes. 2. Nothing contained in this resolution shall be deemed or interpreted by any party to cause any interest created in the public pursuant to this resolution to ripen into any title, interest or right of the public against or adverse to the rights of the City of Redding nor shall this resolution limit, restrict. or modify the exemption of public property to title by prescription as defined within California Civil Code Section 1007. 3. City hereby certifies that the encumbrances documented to reflect Sundial Bridge Drive as a dedicated easement and right-of-way for public street and public utility purposes do not materially impair use of the JP A property. 4. The City Engineer shall cause this resolution to be recorded in the Office of the Recorder of the County of Shasta, California.
