ORDINANCE NO. 2492
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING
AMENDING TITLE 2 - ADMINISTRATION AND PERSONNEL - OF
THE REDDING MUNICIPAL CODE BY ADDING CHAPTER 2.46:
ELECTRIC UTILITY COMMISSION
The City Council of the City of Redding does hereby ordain as follows:
Section 1. Title 2, ADMINISTRATION AND PERSONNEL, of the Redding Municipal
Code is hereby amended by adding a new Chapter 2.46 as follows:

Duties.
2.46.010.
Established.
There is created and established a City Commission which is named "The Electric Utility
Commission," and which is referred to in this Chapter as "Commission." This Commission shall
act in an advisory capacity to the City Council.
2.46.020.
Members - Appointment - Terms - Vacancies.
The Commission shall consist of seven (7) members, who shall be residents of the City of
Redding. All members shall be selected based on their qualifications by reason of their knowledge
and experience by the Mayor, with and subject to the approval of the City Council. In considering
the qualifications of applicants for appointment, the Mayor shall strive to ensure whenever practical
that the Commission as a whole is balanced with members from a variety of backgrounds as set forth
in this Section. At least one member should be a certified public accountant, or the equivalent, at
least one member should be an electrical engineer, or the equivalent, and at least one member should

be an attorney. All members should be ratepayers of the utility. The term of office of all members
so appointed shall be for four (4) years, except for initial appointments and except that if a vacancy
shall occur for any reason other than the expiration of the term of that member's office, it shall be
filled by appointment by the Mayor, with and subject to the approval of the City Council, for the
unexpired portion of the term ofthe member whose office is vacated. Initial appointments shall be
made as follows: Two (2) members shall be appointed for two (2) years; two (2) members shall be
appointed for three (3) years; and three (3) members shall be appointed for four (4) years.
Subsequent appointments shall be for the regular time as set forth above.
2.46.030.
Members - Advisory.
The Council member appointed by the City Council as liaison to the Redding Electric Utility
Department, the Director of the Electric Department, and the City Attorney shall be advisory
members of the Commission. They shall have no vote, and they shall not be considered members
for purposes of constituting a quorum. Their terms of office as advisory members shall correspond
in tenure to their official tenure as officials of the City. Advisory members may designate an
appropriate deputy from staff to attend meetings of the Commission in their place and stead on such
occasions as their other duties may prevent them from sitting in attendance at particular Commission
meetings. Any additional staff support services to the Commission shall be provided by the Redding
Electric Utility Department.
2.46.040.
Members - Removal.
Any appointed member of the Commission may be removed by the City Council. Any
appointed member of the Commission who fails to attend four (4) consecutive meetings of the
Commission without permission from the City Council to be absent shall be considered
automatically removed and a vacancy shall be deemed to have occurred unless good cause is shown.
The City Council shall be the sole judge as to whether or not good cause is shown; and when it is
determined that good cause has not been shown, then the vacancy so created shall be filled
immediately by the Mayor, with and subject to the approval of the City Council, for the unexpired
portion of the term.
2.46.050.
Members - Compensation.
All appointed members of the Commission shall serve as members without compensation.
2.46.060.
Officers.
There shall be two (2) Officers in the Commission - a Chair and a Vice-Chair. An advisory
member ofthe Commission may not hold the office of Chair or of Vice-Chair. The Electric Director
or his duly designated subordinate shall be Secretary to the Commission. The Commission shall
elect its Officers at the first regular meeting of the Commission in January of each year, and they
shall hold office for a term of one (1) year, and any vacancy in any of the offices shall be filled by
the Commission at the first regular meeting of the Commission after the vacancy occurs and shall
be filled for the unexpired portion of the term of office to be filled. The Chair shall preside at all
meetings of the Commission, and in the Chair's absence the Vice-Chair shall preside. The Secretary
shall make and keep a record of all the resolutions, transactions, findings and determinations ofthe
Commission, and shall record and keep the minutes of the Commission meetings.

2.46.070.
Meetings - Time.
The Commission shall meet at 6:00 p.m. on the third Thursday of each and every month,
except when that day falls on a legal holiday, in which case the meeting shall be held on the day
following the holiday, and the meeting shall be a regular meeting of the Commission. The
Commission may adjourn any regular meeting of the Commission from time-to-time or place-to-
place so long as the adjournment shall not extend to a point in time beyond the day of the next
regular meeting of the Commission.
2.46.080.
Meetings - Special.
To call a special meeting, the Chair or a majority ofthe members shall file with the Secretary
ofthe Commission, at least 24 hours prior to the date that the meeting is to be held, a signed written
notice of the meeting, which notice shall specify the time and place of the special meeting and the
agenda therefore. The signed written notice shall also be served personally or by certified mail upon
all members of the Commission who did not sign the notice of the special meeting. Twenty-four
(24) hours' notice in writing shall also be given to all newspapers, radio stations and television
stations which have filed a request for notice in writing with the City Clerk or the Secretary of the
Commission. The presence of all members at the special meeting, or the waiver of notice in writing
by any absent members, shall constitute a waiver of the requirement of notice as it relates to
members.
2.46.090.
Meetings - Place - Quorum.
Regular meetings shall be held at City Hall. Adjourned regular meetings, special meetings,
and regular meetings when deemed necessary may be held elsewhere within the City, provided notice
of the time and place of the meetings and of the agenda of special meetings is given to all members
of the Commission and to all newspapers, radio stations and television stations which have filed a
request for notice in writing with the City Clerk or with the Secretary of the Commission. A
majority of the members ofthe Commission shall constitute a quorum for the transaction ofbusiness
at any regular or special meeting of the Commission.
2.46.100.
Duties.
The Electric Utility Commission shall have the following duties and responsibilities:
A. To act as an advisory body to the City Council and make recommendations to the
City Council regarding the Electric Utility based upon the review of materials
relevant to the areas of electrical power needs projection; acquisition or construction
of electrical power generation; transmission facilities; joint powers agency activities;
public benefits program development; renewable energy integration policy
development; billing policies; and other areas of electric utility operational concerns
deemed appropriate from time-to-time by the City Council; and
B. Recommend fiscal policies to the City Council such as rate, reserve and capital
replacement policies; and
C. Recommend political action to the City Council on energy-related matters.

Section 2. The passage ofthis ordinance is not a "project" according to the definition in the,
California Environmental Quality Act, and therefore is not subject to the provisions requiring
environmental review.
Section 3. This ordinance shall take effect 30 days after the date of its adoption, and the City
Clerk shall certify to the adoption thereof and cause its publication according to law.
I HEREBY CERTIFY that the foregoing ordinance was introduced and read by the City Council
at a regular meeting on the 5th day of February, 2013; and was duly read and adopted at a regular
meeting on the 19th day of February, 2013, by the following vote:
