RESOLUTION NO. 2012-079
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF SHASTA STREET LYING
BETWEEN LIBERTY STREET AND CONTINENT AL STREET, AS
CREATED BY THE MAP OF FRISBIE'S, WALDEN'S, AND HONN'S
ADDITIONS TO THE TOWN OF REDDING, SHASTA COUNTY,
CALIFORNIA, IN BOOK OF TOWN PLATS AT PAGE 34, FILED
OCTOBER 14, 1887, SHASTA COUNTY RECORDS, ADJACENT TO
PROPERTY LOCATED AT 1255 LIBERTY STREET (A-I-90)
WHEREAS:
A. The portion of Shasta Street being considered for summary vacation was created by
the map of Frisbie's, Walden's, and Honn's Additions to the Town of Redding, Shasta County,
California, in Book of Town Plats at Page 34, filed October 14, 1887, Shasta County Records.
B. This portion of street right-of-way has not been used for the purpose for which it was
dedicated or acquired for five consecutive years immediately preceding this vacation. Therefore,
the owner of the property has asked that the City vacate this portion of street right-of-way,
described in Exhibit "A" and shown hatched on Exhibit "B," attached and made a part hereof by
reference.
C. The Engineering Division of the Public Works Department has advised the City
Council that there are in-place public-utility facilities that are in use or that would be affected by
the proposed vacation; therefore, the City is retaining a public-service easement over the portion
of Shasta Street described in Exhibit "A" and shown hatched on Exhibit "B."
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:

The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.

2. The City Council approves the request to summarily vacate that portion of Shasta Street,
described in Exhibit "A" and shown hatched on Exhibit "8."
3. This portion of Shasta Street has not been used for the purpose for which it was dedicated
or acquired for five consecutive years immediately preceding this vacation.
4. The City reserves and excepts from the vacation an easement for sidewalks and
appurtenances and a public-service easement for the purpose of erecting, installing,
constructing, removing, repairing, replacing, reconstructing, maintaining, and using for
public-serviCe purposes any - and all materials, fixtures, appliances, equipment, pipes,
pipelines, wires, and cables (including fiber optics) necessary for the transmission,
distribution, and delivery of electricity, water, sewer, stormwater, gas, cable television,
communication, and information service utilities over, along, upon, under, and across the
portion of Shasta Street described in Exhibit "A" and shown hatched on Exhibit "8."
5. The City Clerk is directed to cause a certified copy of this Resolution of Vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder. -

a regular meeting of the City Council on the 4th day of September, 2012, by the following vote:
