RESOLUTION NO. 2012-063
LANDSCAPE MAINTENANCE DISTRICTS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
(1) CONFIRMING THE MAPS OF THE ASSESSMENT DISTRICTS
CONT AINED IN THE ENGINEER'S REPORTS ON FILE WITH THE
CITY CLERK
(2) CONFIRMING THE ANNUAL ASSESSMENTS AND ORDERING THE
LEVY AMOUNTS FOR FISCAL YEAR 2012-13 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH
SECTION 22500 OF THE STREETS AND HIGHWAYS CODE
WHEREAS:
A. On June 19,2012, by Resolution 2012-052, the City Council approved the Reports of the
Engineer as filed with the City Clerk relating to the Landscape Maintenance Districts
outlined in the table below and gave notice of the time and place of the July 17, 2012,
public hearing regarding the levy and collection of assessments for fiscal year 2012-13.
B. A general location of each District is included in the table below, and maps of these
Districts are attached to the Engineer's Reports on file with the City Clerk.
C. The public hearing, duly and properly noticed, commenced at the City Council Chambers,
777 Cypress Avenue, Redding, California on July 17, 2012, and was concluded prior to the
adoption of this resolution. At the public hearing, the City Council gave every interested
person an opportunity to object to the proposed assessments.
D. The assessments for fiscal year 2012-13 are outlined in the table below. These assessments
do not represent an increase within the meaning of the Streets and Highways Code Sections
22624 and 22630.5 because the FY 2012-13 cost-of-living adjustment in the amount of
2.9 percent is pursuant to a methodology approved at the time of the formation of the
District.
E. All legal prerequisites to the adoption of this resolution have occurred.
THEREFORE THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND
ORDERS AS FOLLOWS:
1. The matters set forth above are true and correct.
2. The maps of the assessment districts contained in the Engineer's Reports are confirmed.

3. City Council has considered all oral statements and written protests or communications
made or filed by interested persons at the public hearing of July 17, 2012, and expressly
overrules any and all protests filed objecting to the proposed annual assessments and levy
amounts in the Districts.

4. The City Council finds that the Engineer's Reports have fairly and properly apportioned the
costs of the improvements to each developable lot, remaining parcel, or assessable acre of
land in the districts in proportion to the estimated benefits to be received by each
developable lot, remaining parcel, or assessable acre from the improvements.
5. The assessments against each developable lot, remaining parcel, or assessable acre located
within the Districts for fiscal year 2012-13 are confirmed, adopted, and levied as outlined
in the table below, except that an assessment shall not be levied on property owned by a
federal or state governmental agency or another local agency. Notwithstanding the
preceding, said assessments shall not be levied during fiscal year 2012-13 for any District
with a 'Stay' as outlined in the table below. Due to sufficient account balances, the levy
amounts for some Districts were reduced as outlined in the table below.
6. The City Clerk shall forthwith transfer to the Auditor Controller and the Assessor Recorder
of Shasta County a certified copy of this resolution and a certified copy of the assessment
district maps contained in the Engineer's Reports for the Landscape Maintenance Districts
outlined in the table below.
7. The City Clerk gave notice of said hearing pursuant to the Streets and Highways Code
Section 22626(a).
