HomeMy WebLinkAboutReso 2012-056 - Residential Impact Fees ... ... e e RESOLUTION NO. 2012-056 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING THE PROGRAM FOR TEMPORARY WAIVER OF CERTAIN RESIDENTIAL IMPACT FEES WHEREAS, "at the October 18,2011, regular meeting of the Redding City Council, the City Council considered a report from the City Manager regarding the status of the City's various impact fee programs; and WHEREAS, outlined in the above-referenced report was a conceptual proposal to waive certain impact fees to help rejuvenate the depressed residential construction business during this recession and generate the associated economic benefits of new home construction for the City of Redding; and WHEREAS, a limited waiver of certain fees, specifically traffic impact fees and sewer impact fees, is justified due to the fact that there has been a recent influx of funding from the state and federal government, unanticipated at the time the impact fee program was created, and those funds have been used to pay for capital improvements anticipated to be funded with the impact fee program; and WHEREAS, on November 15, 2011, the City Council adopted Resolution 2011-194 implementing a temporary waiver of wastewater and traffic impact fees on new single- family dwellings, as follows: The single-family residential impact fees normally collected pursuant to Redding Municipal Code Sections 16.20.090.C.1.a.i, 16.20.040.C.1 and 16.20.072.D.1 shall be conditionally waived for the first 50 single-family residential dwelling-unit permits issued prior" to June 30, 2012. A condition of the waiver is that the certificate of occupancy (C of 0) for the dwelling must be issued no later than March 31,2013. If a C of 0 is not issued by the March 31, 2013, deadline, the conditionally waived impact fees shall be immediately due and payable to the City. All other fees imposed as a condition of development shall remain in full force and effect. WHEREAS, as of February 7,2012, twenty-nine (29) permits for single-family dwelling units have been pulled and public requests have been made for the City to consider extending program eligibility to duplexes. WHEREAS, on February 21,2012, the City Council adopted Resolution 2012-014 amending the temporary waiver of wastewater and traffic impact fees as follows: In addition to the program approved on November 15,2011, the residential impact fees normally collected pursuant to Redding Municipal Code Sections 16.20.090.C.1.a.i, 16.20.040.C., and 16.20.072.D shall be conditionally waived for the second 50 residential dwelling-units for single-family residences or duplexes with permits issued prior to June 30, 2012. For duplex buildings, one building shall qualify for one credit of the 50 available and the credit against fees shall be limited to the same maximum credit allowed per single-family dwelling unit. A condition of any waiver is that the certificate of occupancy (C of 0) for the dwelling must be issued no sooner than February 8,2012, and no later than March 31,2013. If a C of 0 is not issued by the March 31,2013, deadline, the conditionally waived impact fees shall be immediately due and payable to the City. All other fees imposed as a condition of development shall remain in full force and effect. ~ \ ~ o ~ I \:) lI\ ~ ., . r e e WHEREAS, at the regular meeting of the City Council on May 15, 2012, City staff sought further policy direction from Council relative to the impact fee waiver program, and the following direction was provided, as reflected in the official minutes from the meeting: ACTION: Directed staffto return at a future Council meeting with: (1) a recommendation regarding the feasability of extending the Traffic and Wastewater Impact Fee Waiver Program (FWP) with partial fee reductions; (2) a resolution to extend the current FWP under the same terms and conditions until alII 00 authorized permits have been issued; and (3) a recommendation regarding the potential revenue impact of including fourplexes and/or multi-family units into the FWP. WHEREAS, on June 19,2012, the City Council adopted Resolution 2012-046 further amending the temporary waiver of wastewater and traffic impact fees as follows: In addition to the program approved on November 15,2011, the residential impact fees normally collected pursuant to Redding Municipal Code Sections 16.20.090.C.l.a.i, 16.20.040.C., and 16.20.072.0 shall be conditionally waived for the second 50 residential dwelling-units for single- family residences or duplexes until alII 00 permits authorized for the waiver have been issued. For duplex buildings, one building shall qualify for one credit ofthe 50 available and the credit against fees shall be limited to the same maximum credit allowed per single-family dwelling unit. A condition of any waiver is that the certificate of occupancy (C of 0) for the dwelling must be issued no sooner than February 8,2012, and no later than March 31, 2013. NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of Redding that as a means to implement Part (1) ofthe direction described above, the impact fee waiver program as extended and approved on February 21,2012, and modified on June 19,2012, shall be further amended as follows: After all 100 permits authorized for full waiver have been issued, the residential impact fees normally collected pursuant to Redding Municipal Code Sections 6.20.090.C.l.a.i, 16.20.040.C., and 16.20.072.0 shall be conditionally discounted as follows: In the amount of 50% for up to 50 permits for residential dwelling-units for single-family residences issued between July 1, 2012, and December 31,2012. Permits issued during this time frame for duplex, tri-plex and four-plex buildings may also qualify for the waiver program, however one building shall qualify for one credit of the 50 available and the credit against fees shall be limited to the maximum credit allowed per single-family dwelling unit. A condition of any waiver is that the certificate of occupancy (C of 0) for the dwelling unit(s) must be issued no later than September 1, 2013. If a C of 0 is not issued by the September 1,2013, deadline, the conditionally waived impact fees shall be immediately due and payable to the City. All other fees imposed as a condition of development shall remain in full force and effect. BE IT FURTHER RESOLVED that the Council hereby finds and determines that the passage of this resolution is exempt from the California Environmental Quality Act (Public Resources Code section 21000 et seq.) (tfCEQAtf) pursuant to CEQA Guidelines Section 15378(b)(4) (CalifornIa Code of Regulations Section 15378(b)(4)) because it is a fiscal activity that does not involve any commitment to any specific project that may result in a potentially significant impact on the environment.
