Code ~6103 A.P.N.1l7-160-001 .f?r~-'- -'W:-;;j~ ~~&Uu\l~ ~I MAY 1 '7 2012 ... ~- RESOLUTION NO. 2012-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARIL Y VACATING A PUBLIC-SERVICE EASEMENT SHOWN ON , . , LOT' 23," RIVER HEIGHTS SUBDIVISION, REOORDED NOVEMBER 7; 1989, IN BOOK 19 OF MAPS, AT PAGE 47, SHASTA COUNTY RECORDS (914 RIVER BEND ROAD; AB-2011-00075) WHEREAS: A. A public-service easement located on Lot 23 was dedicated to the City of Redding with the recording of River Heights Subdivision, recorded November 7, 1989, in Book 19 of Maps at Page 47, Shasta County Records (hereafter called the Easement). B. The owner of the property has asked that the City vacate the Easement, as described' in Exhibit A and shown highlighted on Exhibit B, attached and made a part hereof by reference. No utilities have been placed in the Easement, and it is not needed for the purposes for which it was dedicated. C. The Engineering Division of the Public Works Department has advised the City Council that there are no in-place public-utility facilities that are in use or would be affected by the proposed summary vacation, and that the Easement, as described in Exhibit A and shown on Exhibit B, is not required for public use. NOW, THEREFORE; THE CITY COUNCIL'nETERMINES, RESOLVES, AND ORDERS AS FOLLOWS": '" "' '.' ." " .. t' ': 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the Easement located on Lot 23, dedicated to the City of Redding on River Heights Subdivision, recorded November 7, 1989, in Book 19 of Maps at Page 47, Shasta County Records, as described in Exhibit A and shown on Exhibit B. ".- . . 3. The easement being vacated is not needed for the purposes for which it was dedicated, and there are no public facilities located therein. Therefore, from and after the date this resolution is recorded, that the Easement, as described in Exhibit A and shown on Exhibit B, shall be vacated in its entirety and no longer constitute an easement for public-service purposes. 4. The City Clerk is directed to cause a certified copy of this resolution of summary vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County AssessorlRecorder.
