RECORDING REQUESTED BY: WHEN RECORDED RETURN TO: CITY OF REDDING CITY CLERK'S OFFICE, 3RD FLOOR 777 CYPRESS AVENUE REDDING, CA 96001 THE AREA ABOVE IS RESERVED FOR RECORDER'S USE Resolution No. 2011-146 Landscape Maintenance District "3-06" (Hope Subdivision) "Separate Page" pursuant to Government Code g27361.6 ..~ e e RESOLUTION NO. 2011 - 146 LANDSCAPE MAINTENANCE DISTRICT "3-06" (Hope Subdivision) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING (1) CONFIRMING THE MAP OF THE ASSESSMENT DISTRICT CONTAINED IN THE ENGINEER'S REPORT (2) CONFIRMING THE ANNUAL ASSESSMENT AND ORDERING THE LEVY AMOUNT FOR FISCAL YEAR 2011-12 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE WHEREAS: A. On June 21,2011, by Resolution 2011-94, City Council approved the Report ofthe Engineer as filed relating to Landscape Maintenance District "3-06" (District) and gave notice of the time and place ofthe July 19, 2011, public hearing regarding the levy and collection of assessments for Fiscal Year 2011-12. B. A map of the area in the District is attached and made a part hereof. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 777 Cypress Avenue, Redding, California on July 19,2011, and was concluded prior to the adoption of this resolution. At the public hearing, City Council gave every interested person an opportunity to object to the proposed assessment. D. The assessment for Fiscal Year 2011-12 is $423.27, which is not an increase within the meaning of Streets and Highways Code ~ 22624 and 22630.5, because the cost ofliving adjustment in the amount of $15.89 is pursuant to a methodology approved at the time of the formation of the District. E. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE THE CITY COUNCIL FINDS, RESOL YES, DETERMINES, AND ORDERS AS FOLLOWS: 1. The matters set forth above are true and correct. 2. The map of the assessment district contained in the Engineer's Report is confirmed. 3. City Council has considered all oral statements and written protests or communications made or filed by interested persons at the public hearing of July 19, 2011, and expressly overrules any and all protests filed objecting to the proposed annual assessment and levy amount in the District. ~ ............. ~ ~ -c: 0'. ~ e e 4. The City Council finds that the Engineer's Report has fairly and properly apportioned the costs of the improvements to each lot/remaining parcel of land in the district in proportion to the estimated benefits to be received by each lot/remaining parcel ofland from the improvements. 5. An assessment of$423.27 against each developable lot/remaining parcel located within the District for Fiscal Year 2011-12 is confirmed and adopted. Notwithstanding the preceding, said assessment shall not be levied during Fiscal Year 2011-12. 6. The City Clerk shall forthwith transfer to the Auditor Controller and the Assessor Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment district map contained in the Engineer's Report for Landscape Maintenance District "3-06." 7. That the City Clerk gave notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
