A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING: (1) ACCEPTING THE PROPOSED DISTRICT PROPERTY OWNERS' PETITION OF FORMATION; (2) CONFIRMING THE MAP OF THE ASSESSMENT DISTRICT AND APPROVING THE ENGINEER'S REPORT; (3) APPROVING THE MAILING OF NOTICE AND BALLOTS; AND (4) SETTING A PUBLIC HEARING AND ELECTION REGARDING LANDSCAPE MAINTENANCE DISTRICT LMD 03-11 WHEREAS: A. The proposed district property owners have turned in a petition of formation with the signatures of 57 of the 87 property owners, which equals 65.5 percent of the district property owners. B. The Engineer has filed his report with the City Clerk, pursuant to Streets and Highways Code Section 22565, et seq., setting forth a full and detailed description of the improvements, the boundaries of the proposed assessment district and any zones therein, any bonds or notes to be issued, and the proposed assessments upon assessable lots and parcels ofland within the proposed district. c. The purpose ofthe proposed district, which is located at the intersection of Hilltop Drive and River Bend Road and along River Bend Road, is to provide maintenance to landscaped improvements. ~ ""'-.. The purpose of the public hearing is to provide the owners of parcels within the boundary of the proposed landscape maintenance district with the opportunity to make the decision on how the shortfall of funds for maintenance of the landscape should be resolved and to comply with the requirements of Section 22593 of the Streets and Highways Code and Section 53753 of the Government Code. E. City Council Policy No. 1705 requires that, in regard to landscape maintenance districts, "To the degree practical, properties within the boundaries of a district shall bear the full costs of ongoing administration of the district and the maintenance of district improvements." F. The City Council proposes to levy the proposed special assessment based on a uniform special benefit and assessment methodology over all developable lots within the proposed District. G. This resolution is made in satisfaction of those requirements set forth in the Streets and Highways Code Section 22587. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL THAT: 1. The foregoing recitals are true and correct. 2. The City Council accepts the proposed district property owners' petition of formation. 3. Pursuant to the Streets and Highways Code Section 22586, the City Council hereby accepts the district residents' petition of formation; approves the Report ofthe Engineer as filed with the City Clerk, containing a full and detailed description ofthe improvements, the boundaries of proposed LANDSCAPE MAINTENANCE DISTRICT 03-11 and any zones therein, any bonds or notes to be issued; and the proposed assessments upon assessable lots/parcels within said district. 4. The City Council finds that the Engineer's Report has fairly and properly apportioned the costs of the improvements to each residential unit in the district in proportion to the estimated benefits to be received by each benefit unit from the improvements. 5. A notice and ballots will be mailed and a public hearing and election will be held on Tuesday, September 6,2011, at the hour of6 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the levy of the proposed assessment for Fiscal Year 2011-12.
