RESOLUTION NO. 2011 - 116
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARIL Y VACATING A TEMPORARY CONSTRUCTION
EASEMENT ON PROPERTY LOCATED AT 290 HEMS TED DRIVE
(A-4-11)
WHEREAS:
A. Shasta Enterprises, a Partnership, granted a temporary construction easement to the
City of Redding to facilitate the construction of the Cypress A venue Bridge with the recording of
an Easement Deed on March 02, 2007, as document number 2007-0010246, Shasta County
Official Records.
B. The construction of the Cypress Avenue Bridge project is completed and the City
would like to summarily vacate the temporary construction easement, as described in Exhibit A,
attached and made a part hereof by reference, as it is no longer needed for the purposes for which
it was dedicated.
C. The Engineering Division of the Public Works Department has advised the City
Council that there are no in-place public-utility facilities that are in use or would be affected by
the proposed vacation and that the temporary construction easement, as described in Exhibit A, is
not required for public use.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2.
The City Council approves the request to summarily vacate the temporary construction
easement as described in Exhibit A.
3.
The temporary construction easement being vacated is not needed for the purposes for
which it was dedicated; it is not required; and there are no public facilities that are

affected by this vacation. Therefore, from and after the date that this resolution is
recorded, the temporary construction easement, as described in Exhibit A, shall be
vacated in its entirety and no longer constitute a temporary construction easement.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
at a regular meeting of the City Council on the 19th day of July, 2011, by the following vote:
