RESOLUTION NO. ~011 - 115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING TEMPORARY CONSTRUCTION
EASEMENTS ON PROPERTY LOCATED AT 3001 PARK MARINA
DRIVEAND 3000 PARK MARINA DRIVE (A-4-11)1'
WHEREAS:
A. Louis J. Gerard, Jr., And Diane M. Gerard, Trustees of the Gerard 1994 Revocable
Living Trust, Established June 28, 1994, granted temporary construction easements to the City of
Redding to facilitate the construction of the Cypress Avenue Bridge with the recording of
Easement Deeds March 2,2007, as document numbers 2007-0010242 and 2007-0010243, Shasta
County Official Records.
B. The construction of the Cypress Avenue Bridge project is completed and the City
would like to summarily vacate the temporary construction easements, as described in Exhibit A,
attached and made a part hereof by reference, as they are no longer needed for the purposes for
which they were dedicated.
C. The Engineering Division of the Public Works Department has advised the City
Council that there are no in-place public-utility facilities that are in use or would be affected by
the proposed vacation, and that the temporary construction easements, as described in Exhibit A,
are not required for public use.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.

The City Council approves the request to summarily vacate the temporary construction
easements as described in Exhibit A.

The temporary construction easements being vacated are not needed for the purposes for
which they were dedicated; they are not required; and there are no public facilities that are

affected by this vacation. Therefore, from and after the date this resolution is recorded,
the temporary construction easements, as described in Exhibit A, shall be vacated in their
entirety and no longer constitute temporary construction easements.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at
a regular meeting of the City Council on the 19th day of July, 2011, by the following vote:

"EASEMENT DEED" dated November 02,2006, by and between Louis J. Gerard, Jr., and Diane
M. Gerard, Trustees of the Gerard 1994 Revocable Living Trust, established June 28, 1994,
grantor and the City of Redding, grantee, recorded March 02, 2007, as document number
2007-0010242, Shasta County Official Records,
and also the Temporary Construction Easements described as Parcel No.3 & Parcel No.4 in the
document titled "EASEMENT DEED" dated February 02,2007, by and between Louis J. Gerard,
Jr., And Diane M. Gerard, Trustees of the Gerard 1994 Revocable Living Trust, established
June 28, 1994, grantor and the City of Redding, grantee, recorded March 02, 2007 as document
number 2007-0010243, Shasta County Official Records.
