RESOLUTION NO. 2011 - 89
LANDSCAPE MAINTENANCE DISTRICT "u" (Bel Air Estates)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE REPORT OF THE ENGINEER AS FILED, AND
DECLARING ITS INTENTION TO:
(1) SET A PUBLIC HEARING DATE RE LANDSCAPE MAINTENANCE
DISTRICT "U."
(2) LEVY AND COLLECT ASSESSMENTS IN DISTRICT "u" FOR FISCAL
YEAR 2011-12 PURSUANT TO THE LANDSCAPING AND LIGHTING
ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE
STREETS AND HIGHWAYS CODE.
WHEREAS:
A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance
District "U" (District) under authority granted by the Landscaping and Lighting Act of
1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of
California.
B. The purpose ofthe District is to provide maintenance to those landscaping improvements
required within the public rights-of-way and/or easements by the conditions of
development approval of Bel Air Estates, generally located west of the intersection with
Quartz Hill Road and Stone Canyon Drive.
C. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways
Code Section 22565, et seq.
D. This Resolution is made in satisfaction of those requirements set forth in the Streets and
Highways Code Section 22624.
E. The assessment for Fiscal Year 2011-12 is not an increase within the meaning of Streets
and Highways Code S22624 and 22630.5 because the cost ofliving adjustment provided
for herein was approved at the time of the formation of the District.
NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT:
1. The matters set forth above are true, correct, and are adopted herein.
2. Pursuant to the Streets and Highways Code S22623, the Report ofthe Engineer, as filed, is
hereby approved.
3. The Report of the Engineer, on file with the City Clerk, contains a full and detailed G ~
description of the improvements, the boundaries of the District and any zones therein, and 5
the proposed assessments upon the assessable acres and remaining parcels within the "-.,

4. The existing improvements for each subdivision in the District are set forth in Part B ofthe
Engineer's Report, on file with the City Clerk.
5. The general locations ofthe acres and remaining parcels in the District are set forth in Part
A ofthe Engineer's Report, on file with the City Clerk.
6. Only costs for the maintenance oflandscaping; miscellaneous lighting; mulching;
vandalism; repairs to the irrigation system; electric and water charges; replacement of
vegetation as necessary; removal of trimmings, rubbish, and debris; maintenance of the
detention basin; and other improvements to remove or cover graffiti, administrative costs,
painting of any walls, and such other maintenance and incidental expenses as are
authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed.
7. A public hearing will be held on Tuesday, July 19,2011, at the hour of6:00 p.m., or as
soon thereafter as the matter may be heard, in the City Council Chambers located at 777
Cypress A venue, Redding, California, to address the confirmation and approval of the
proposed assessment for Fiscal Year 2011-12. The proposed assessment for Fiscal Year
2011-12 is $80.42 , it being the intention ofthe Council to levy said assessment in the
amount of $80.42 for Fiscal Year 2011-12.
8. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways
Code Section 22626(a).
I HEREBY CERTIFY that the foregoing resolution of intention was introduced, read, and
adopted at a regular meeting ofthe City Council on the 21st day of June 2011, by the following
