HomeMy WebLinkAboutReso 2011-084 - Mill Pond Lane 'it e e RESOLUTION NO. 2011 - 84 LANDSCAPE MAINTENANCE DISTRICT "P" (Mill Pond Lane) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO: (1) SET A PUBLIC HEARING DATE RE LANDSCAPE MAINTENANCE DISTRICT "P." (2) LEVY AND COLLECT ASSESSMENTS IN DISTRICT "P" FOR FISCAL YEAR 2011-12 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District "P" (District) under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval of Mill Pond Estates, generally located east of East Bonnyview Road at the south end of Mill Pond Lane. C. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. D. This Resolution is made in satisfaction ofthose requirements set forth in the Streets and Highways Code Section 22624. E. The assessment for Fiscal Year 2011-12 is not an increase within the meaning of Streets and Highways Code ~22624 and 22630.5 because the cost ofliving adjustment provided for herein was approved at the time of the formation of the District. NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: 1. The matters set forth above are true, correct, and are adopted herein. 2. Pursuant to the Streets and Highways Code ~22623, the Report of the Engineer, as filed, is hereby approved. 3. The Report ofthe Engineer, on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the a~sessable acres and remaining parcels within the District. ~ -... r ~ .r '" e e 4. The existing improvements for each subdivision in the District are set forth in Part B of the Engineer's Report, on file with the City Clerk. 5. The general locations of the acres and remaining parcels in the District are set forth in Part A ofthe Engineer's Report, on file with the City Clerk. 6. Only costs for the maintenance oflandscaping; miscellaneous lighting; mulching; vandalism; repairs to the irrigation system; electric and water charges; replacement of vegetation as necessary; removal of trimmings, rubbish, and debris; maintenance of the detention basin; and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 7. A public hearing will be held on Tuesday, July 19, 2011, at the hour of6:00 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the confirmation and approval of the proposed assessment for Fiscal Year 2011-12. The proposed assessment for Fiscal Year 2011-12 is $617.60, it being the intention of the Council to levy said assessment in the amount of$506.11 for Fiscal Year 2011-12. 8. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
