RESOLUTION NO. 2011 - 54
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF WEST STREET
RIGHT-OF-WAY AND LINDEN AVENUE RIGHT-OF-WAY LOCATED
ADJACENT T02810 WEST STREET (A-8-10)
WHEREAS:
A. The portions being considered for summary vacation were acquired by dedication
with the recording of the Boardman Addition to Redding in 1901.
B. These portions of street right-of-way have not been used for the purpose for which
they were dedicated or acquired. Therefore, the owner of the property has asked that the City
vacate these portions of street right-of-way, described in Exhibit "A" and shown shaded on
Exhibit "B," attached and made a part hereof by reference.
C. The Engineering Division of the Public Works Department has advised the City
Council that there were no objections to the proposed vacation described in Exhibit "A" and
shown shaded on Exhibit "B."
D. The City is retaining a 6.5-foot-wide public-service easement adjacent to the
new right-of-way as shown on Exhibit "B."
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2.
The City Council approves the request to summarily vacate the portion of right-of-way
described in Exhibit "A" and shown hatched on Exhibit "B."
3.
This portion of street right-of-way has not been used for the purpose for which it was
dedicated or acquired for five consecutive years immediately preceding this vacation.

4. The City reserves and excepts from the vacation a 6.S-foot-wide public-service
easement for the purpose of erecting, installing, constructing, removing, repairing,
replacing, reconstructing, maintaining and using for public-service purposes any
and all materials, fixtures, appliances, equipment, pipes, pipelines, wires, and cables
(including fiber optics) necessary for the transmission, distribution, and delivery of
electricity, water, sewer, stormwater, gas, cable television, communication, and
information service utilities over, along, upon, under, and across the parcel of real
property as shown on 'Exhibit "B."
5. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at
a regular meeting of the City Council on the 17th day of May, 2011, by the following vote:

EXHIBIT A
In general, a fifteen (15.00) foot strip along the Southeasterly side of linden Avenue and the
Westerly side of West Street coincident to lot 1 and a portion of Lot 2, Block "0" of the
Boardman Addition to the City of Redding, per Book 1 of Maps, at Page 57, Shasta County
Records, situate in the incorporated limits ofthe City of Redding, Shasta County, California and
being more particularly described as follows and shown on Exhibit B attached hereto:
BEGINNING at the Northerly most corner of said Lot I, the same as shown on that certain
Record of Survey filed in Book 56 of land Surveys, at Page 19, Shasta County Records; thence,
S.5r40'32"W., along said Southeasterly right-of-way line of linden Avenue, 203.43 feet;
thence, at right angles to said line N.3r19'28"W., 15.00 feet; thence, N.5r40'32"E.,
195.72 feet; thence, along the arc of a tangent, 20.00-foot radius curve to the right, through a
central angle of 114003'58", a distance of 39.82 feet; thence, parallel to, and distant 15.00 feet
from the West right of way of said West Street $.08015'30"E., 84.50 feet; thence,
S.84022'55"W., 15.02 feet, to the Westerly right-of-way line of said West Street; thence,
N.08015'30"W., 91.52 feet, more or less, returning to the Point of Beginning, and the end of this
description.
