RESOLUTION NO. 2011 - 43
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF AN OPEN-SPACE,
STORM-DRAINAGE, AND TRAIL-PURPOSE EASEMENT LOCATED
ACROSS THE REAR YARD OF PROPERTY AT 1537 ARROYO MANOR
DRIVE (A-2-11)
WHEREAS:
A. The (portion) open-space, storm-drainage and trail-purpose easement being
considered for summary vacation was dedicated to the City with the recording of Arroyo Manor
Estates in June of 1981 in Book 16 of Maps at Page 95, Shasta County Records.
B. This portion of open-space, storm-drainage and trail-purpose easement has not been
used for the purpose for which it was dedicated or acquired. Therefore, the owner of the property
has asked that the City vacate the portion, described in Exhibit "A" and shown hatched on
Exhibit "B," attached and made a part hereofby reference.
C. The Engineering Division of the Public Works Department has advised the City
Council that the Public Works Department and the Community Services Department have stated
that they have no objections to the Summary Vacation of this portion of the open-space,
storm-drainage, and trail-purpose easement and that there are no in-place public-utility facilities
that are in use or that would be affected by the prQP?sed vacation.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2.
The City Council approves the request to summarily vacate the portion of open-space,
storm-drainage, and trail-purpose easement described in Exhibit "A" and shown hatched
on Exhibit "B."

3. This (portion) open-space, storm-drainage, and trail-purpose easement has not been used
for the purpose for which it was dedicated or acquired for five consecutive years
immediately preceding this vacation.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
at a regular meeting of the City Council on the19th day of April, 2011, by the following vote:
