RESOLUTION NO. 2010 - 167
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PUBLIC SERVICE EASEMENT LOCATED
ACROSS THE REAR OF LOTS OF 1490, 1478, 1466, 1454, AND 1442 JEN
WAY (A-7-10)
WHEREAS:
A. The public-service easement being considered for summary vacation was retained
as part of Resolution No. 2007-174 which vacated a portion of Waushara Avenue acquired by
implied dedication with the map of the Fern Addition to Wooalawn filed March 3, 1888, in Book
of Old Plats at Page 38, Shasta County Records.
B. This public-service easement has not been used for the purpose for which it was
dedicated or acquired. Therefore, the owners of the properties have asked that the City vacate this
public-service easement, described in Exhibit "A" and shown hatched on Exhibit "B," attached
and made a part hereof by reference.
C. The Engineering Division of the Public Works Department has advised the City
Council that there are no in-place public-utility facilities that are in use or that would be affected
by the proposed vacation.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2.
The City Council approves the request to summarily vacate the public-service easement
described in Exhibit "A" and shown hatched on Exhibit "B."
3.
This public service easement has not been used for the purpose for which it was dedicated
or acquired for five consecutive years immediately preceding this vacation.

4. THE CITY RESERVES AND EXCEPTS FROM THIS VACATION, the following
easements shown on the map of Lakeside Avenues Subdivision, recorded March 13,
2006, in Book 23 of Maps at Page 96, Shasta County Records: 5-foot public-service
easement "A", IS-foot sanitary-sewer easement "C", 10-foot public-service easement "J"
and landscape maintenance easement "I."
5. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
at a regular meeting of the City Council on the 16th day of November, 2010, by the following

EXHIBIT A
All that certain real property situate in the City of Redding, County of Shasta, State of
California, lying within Lots 10, 11, 12, 13 and 14 as shown on the map of Lakeside
Avenues Subdivision, S-18-03, recorded in Book 23 of Maps at Page 96, Shasta County
Records (23 M 96), more particularly described as follows:
BEGINNING at the Southwesterly corner of Lot 14 of said (23 M 96) also being the
intersection of the Northeasterly right-of-way of Buenaventura Boulevard and the centerline
of Waushara Avenue as shown on said (23 M 96);
thence South 67019'47" East along the centerline of Waushara Avenue, a distance of
382.22 feet to the Southerly most corner of Lot 10 of said (23 M 96);
thence leaving said centerline North 79016'16" East along the Southeasterly line of said
Lot 10, a distance of 72.67 feet;
thence leaving said Southeasterly line, parallel with the centerline of Waushara Avenue
and 40.00 feet distance therefrom, North 67019'47" West, a distance of 482.44 feet to a
point on the Northeasterly right-of-way of Buenaventura Boulevard;
thence South 22000'18" East along said right-of-way of Buenaventura Boulevard, a
distance of 71.37 feet to the POINT OF BEGINNING;
