Code ~6103 A.P.N. 103-740-024 I REC FEE I I I I I I I iL 11:~ 14-oct-e010 I Page 1 of 4 Recorded Ufficial Hecords County of lihasta Leslie Morgan Assessor-Hecorder RESOLUTION NO. 2010 - 158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF A 10-FOOT SEWER EASEMENT SHOWN ON PARCEL MAP LS-12-87, RECORDED OCTOBER 17, 1988; IN BOOK 27 OF PARCEL MAPS AT PAGE 16, SHASTA COUNTY RECORDS (2770 EUREKA WAY; A-6-10) WHEREAS: A. A lO-foot sewer easement was dedicated to the City of Redding on Parcel Map LS-12-87, recorded October 17, 1988, in Book 27 of Parcel Maps at Page 16, Shasta County . Records (hereafter called the Easement). B. The owners of the property have asked that the City vacate a portion of the Easement, as described in Exhibit A and shown hatched on Exhibit B, attached and made a part hereof by reference, as it has been superceded by relocation and is no longer needed for the purposes for which it was dedicated. C. The Engineering Division of the Public Works Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the proposed vacation, and that the portion of the Easement, as described in Exhibit A and shown hatched on Exhibit B, is not required for public use. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate a portion of the 10-foot sewer easement dedicated to the City of Redding on Parcel Map LS-12-87, recorded October 17, 1988, in Book 27 of Parcel Maps at Page 16, Shasta County Records, as described in Exhibit A and shown hatched on Exhibit B. ~ 0.00 ~ ~... 9 U" ~ i- J ~ e e 3. The easement being vacated has been superceded by relocation and is not needed for the purposes for which it was dedicated; it is not reql!ired; and there are no public facilities located therein. Therefore, from and after the date this resolution is recorded, that portion of the IO-foot sewer easement, as described in Exhibit A and shown hatched on Exhibit B, shall be vacated in its entirety and no longer constitute an easement for sewer purposes. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. C ,f,': ..; ~~ ;::' l:.. ~ e e A.P. 103-740-024 EXHIBIT "A" LAND DESCRIPTION A portion of that 10.00 foot wide sewer easement shown within Parcel #2 on Parcel Map No. LS-12-87 for the Eureka Group filed October 17, 1988, in the office of the Shasta County Recorder, in Book 27 of Parcel Maps at Page 16, being more fully described as follows: Beginning at that angle point on the southerly property line of said Parcel #2 at the westerly terminus of that line with a record bearing ofN 810 53' 49" Was shown on said Parcel Map; thence northerly along the west line of said 10 foot wide sewer easement N 90 10' 00" W, 150.97 feet to an angle point on the South and Westerly line of said 10.00 foot wide sewer easement; thence westerly along said line, S 80041' 50" W, 0.57 feet to a point on the southwesterly line of that 15 foot wide Public Utility Easement (PUE) per document 2009-0018593, filed June 9,2009, in the office of the Shasta County Recorder; thence northeasterly perpendicular to the centerline of said 15' foot wide easement N 38050'51" E, 7.49 feet to the middle of an existing sanitary sewer manhole, thence continuing along the prolongation of said line N 38050' 51" E, 6.73 feet to a point on the east line of said 10.00 foot wide sewer easement; thence southerly along the east side of said 10 foot wide sewer easement, S 90 10' 00" E, 153.12 feet to an angle point on the Easterly line of said 10 foot wide easement; thence southeasterly along the Northerly line of the southeast side of said easement, S 81053' 49" E, 30.76 feet to a point on the East line of the above said 15' wide PUE; thence southwesterly along the East line of said 15 foot wide PUE, S 8016' 18" W, 5.72 feet to the Southeast comer of said 15 foot PUE; thence westerly along the South line of said PUE, S 81051' 56" W, 15.30 feet to a point on the South line of said Parcel #2; thence northwesterly along said South line, N 81053' 49" W, 23.42 feet to the True Point of Beginning. The side lines of the remaining portions of said 10 foot wide sewer easement to be extended or shortened to meet at angle points and terminate at the exterior lines of that 15 foot wide Public Utliity easement per document 2009-0018593, filed June 9,2009, in the office of the Shasta County Recorder.
