(2) APPROVING THE ANNUAL ASSESSMENT FOR FISCAL YEAR 2010-11 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE, AND STAYING THE LEVY OF THE SAME FOR FISCAL YEAR 2010-11. WHEREAS: A. On July 20, 2010, by Resolution 2010-102, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District "8-06" (District) and gave notice ofthe time and place ofthe August 3, 2010, public hearing regarding the levy and collection of the assessment for Fiscal Year 201D-l1. B. A map of the area in the District is attached and made a part hereof. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 777 Cypress A venue, Redding, California on August 3, 20 la, and was concluded prior to the adoption of this resolution. At the public hearing, the City Council gave every interested person an opportunity to object to the proposed assessment. D. The assessment for Fiscal Year 2010-11 is $538.05, which is not an increase within the meaning of Streets and Highways Code ~ 22624 and 22630.5, because the cost of living adjustment in the amount of$8.47 is pursuant to a methodology approved at the time of the formation of the District. E. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. The matters set forth above are true and correct. 2. The map of the assessment district contained in the Engineer's Report are confirmed. 3. The City Council has considered all oral ~tatements and written protests or communications made or filed by interested persons at the public hearing of August 3, 2010, and expressly overrules any and all protests filed objecting to the proposed annual assessment and levy amount in the District. -':. e e 4. The City Council finds that the Engineer's Report has fairly and properly apportioned the costs of the improvements to each lot/remaining parcel of land in the district in proportion to the estimated benefits to be received by each lot/remaining parcel ofland from the improvements. 5. An assessment of $538.05 against each developable lot/remaining parcel located within the District for Fiscal Year 2010--11 is confirmed and adopted. Notwithstanding the preceding, said assessment shall not be levied during Fiscal Year 2010--11. 6. The City Clerk shall forthwith transfer to the Auditor Controller and the Assessor Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment district map contained in the Engineer's Report for Landscape Maintenance District "8-06." 7. That the City Clerk gave notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
