RESOLUTION NO. 2010 - 140
LANDSCAPE MAINTENANCE DISTRICT "7-06" (Buckeye Pines)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
(1) CONFIRMING THE MAP OF THE ASSESSMENT DISTRICT
CONTAINED IN THE ENGINEER'S REPORT.
(2) CONFIRMING THE ANNUAL ASSESSMENT AND ORDERING THE
LEVY AMOUNT FOR FISCAL YEAR 2010-11 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING
WITH SECTION 22500 OFTHE STREETS AND HIGHWAYS CODE.
WHEREAS:
A. On July 20, 2010, by Resolution 2010-101, the City Council approved the Report of the
Engineer as filed relating to Landscape Maintenance District "7 -06" (District) and gave notice
of the time and place ofthe August 3, 2010, public hearing regarding the levy and collection
of assessments for Fiscal Year 2010-11.
B. A map ofthe area in the District is attached and made a part hereof.
C. The public hearing, duly and properly noticed, commenced at the City Council Chambers,
777 Cypress A venue, Redding, California on August 3, 2010, and was concluded prior to the
adoption of this resolution. At the public hearing, the City Council gave every interested
person an opportunity to object to the proposed assessment.
D. The assessment for Fiscal Year 2010-11 is $531.04, which is not an increase within the
meaning of Streets and Highways Code S 22624 and 22630.5, because the cost of living
adjustment in the amount of $8.36 is pursuant to a methodology approved at the time of the
formation of the District.
E. All legal prerequisites to the adoption of this resolution have occurred.
THEREFORE THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND ORDERS
AS FOLLOWS:
1. The matters set forth above are true and correct.
2. The map of the assessment district contained in the Engineer's Report is confirmed.
3. The City Council has considered all oral statements and written protests or communications
made or filed by interested persons at the public hearing of August 3, 2010, and expressly
overrules any and all protests filed objecting to the proposed annual assessment and levy
amount in the District.

4. The City Council finds that the Engineer's Report has fairly and properly apportioned the costs
of the improvements to each lot/remaining parcel of land in the district in proportion to the
estimated benefits to be received by each lot/remaining parcel ofland from the improvements.
5. An assessment of $531.04 against each developable lot/remaining parcel located within the
District for Fiscal Year 2010-11 is adopted, confirmed, and levied in the amount of$531.04,
except that an assessment shall not be levied on property owned by a Federal or State
governmental agency or another local agency.
6. The City Clerk shall forthwith transfer to the Auditor Controller and the Assessor Recorder of
Shasta County a certified copy ofthis resolution and a certified copy of the assessment district
map contained in the Engineer's Report for Landscape Maintenance District "7-06."
7. That the City Clerk gave notice of said hearing pursuant to the Streets and Highways Code
Section 22626(a).
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted at a special
meeting ofthe City Council on the 3rd day of August, 2010, by the following vote:
