Four public-utility easements are on property located at 850 and 997 Roseland Street, 975 Shasta View Drive, and 987 Gibralter Road; three of these easements were originally granted to PG&E and assigned to the City in 1993 with the recording of "Assignment of Easements" filed in Book 2982 of Official Records at Page 608; the fourth easement was dedicated to Shasta County in 1978 with the recording of Parcel Map 451-78, filed in Book 16 of Parcel Maps at Page 144, and transferred to the City with annexation of this area in 1989 (hereafter called the Easements). B. The owner of the property has asked that the City vacate the Easements, as described in Exhibit A and shown hatched on Exhibit B, attached and made a part hereof by reference, as they have been superceded by relocation and are no longer needed for the purposes for which they were dedicated. C. The Engineering Division of the Public Works Department has advised the City Council that there are no in-place public-utility facilities that are in use or would be affected by the proposed vacation, and that the Easements, as described in Exhibit A and shown hatched on Exhibit B, are not required for public use. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: 1. The City Council elects to proceed in this matter under the provisions of the California Streets and Highways Code, Section 8333. 2. The City Council approves the request to summarily vacate the Easements as described in Exhibit A and shown hatched on Exhibit B. t..! Nr 0.00 ~ D , "-J -...... .~ '- , e e 3. The easements being vacated have been superceded by relocation, and the Easements are not needed for the purposes for which they were dedicated; they are not required; and there are no public facilities that are affected by this vacation. Therefore, from and after the date this resolution is recorded, the Easements, as described in Exhibit A and shown hatched on Exhibit B, shall be vacated in there entirety and no longer constitute easements for public utilities. 4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder. That easement granted to Pacific Gas and Electric Company, recorded October 25, 1979 in Book 1672 of Official Records at Page 574, Shasta County Records, and transferred to the City of Redding by "Assignment Of Easements" recorded March 30, 1993 in Book 2982 of Official Records at Page 608, Shasta County Records. . 2. That easement granted to Pacific Gas and Electric Company, recorded August 25, 1982 in Book 1908 of Official Records at Page 557, Shasta County Records, and transferred to the City of Redding by "Assignment Of Easements" recorded March 30, 1993 in Book 2982 of Official Records at Page 608, Shasta County Records.. 3. That easement granted to Pacific Gas and Electric Company, recorded August 25, 1982 in Book 1908 of Official Records at Page 559, Shasta County Records, and transferred to the City of Redding by "Assignment Of Easements" recorded March 30, 1993 in Book 2982 of Official Records at Page 608, Shasta County Records.. 4. That 60 foot Public Utility Dedication Shown on the map filed November 30, 1978 in Book 16 of Parcel Maps at Page 144, Shasta County Records. \~.
