RESOLUTION NO. 2010 - 69 .
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING VARIOUS EASEMENTS DEDICATED ON
PARCEL MAP LS-13-95, RECORDED DECEMBER 31, 1996, IN BOOK 32
OF PARCEL MAPS AT PAGE 6, AND GRANTED IN DOCUMENTS 2008-
0012232 AND 2008-0012234, RECORDED APRIL 11,2008, SHASTA COUNTY
RECORDS (1515 DANA DRIVE: A-2-10)
WHEREAS:
A. Various easements for public service, sewer, waterline and storm drains were
dedicated to the City of Redding on Parcel Map LS-13-95, Recorded December 31, 1996, in
Book 32 of Parcel Maps at Page 6, and granted in Documents 2008-0012232 and 2008-0012234,
recorded April 11, 2008, Shasta County Recorder (hereafter called the Easements).
B. The owner of the property, Wal-Mart Real Estate Business Trust, has asked that the
City vacate the Easements, as described in Exhibit A and shown hatched on Exhibit B, attached
and made a part hereof by reference, and the Easements granted as Document 2008-0012232 and
Document 2008-0012234, as shown hatched on Exhibit C, attached and made a part hereof by
reference, as they have been superceded by relocation and. are no longer needed for the purposes
for which they were dedicated.
C. The Engineering Division of the Public Works Department has advised the City
Council that there are no in-place public utility facilities that are in use or would be affected by
the proposed vacation, and that the Easements, as described in Exhibit A and shown hatched on
Exhibit B, and the Easements granted as Document 2008-0012232 and as Document 2008-
0012234 are not required for public use.

NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
I. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2. The City Council approves the request to summarily vacate the various Easements
dedicated to the City of Redding on Parcel Map LS-13-95, recorded December 31, 1996,
in Book 32 of Parcel Maps at Page 6, as described in Exhibit A and shown hatched on
Exhibit B, and the Easements granted as Document 2008-0012232 and as Document
2008-0012234, Recorded April II, 2008, Shasta County Records, as shown on Exhibit C.
3. The easements being vacated have been superceded by relocation and are not needed for
the purposes for which they were dedicated; they are not required; and there are no public
facilities located therein. Therefore, from and after the date this resolution is recorded,
the various Easements as described in Exhibit A and shown hatched on Exhibit B, and the
Easements granted as Documents 2008-0012232 and 2008-0012234 as shown on
Exhibit C, shall be vacated in their entirety and no longer constitute easements for public
purposes.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.

a regular meeting of the City Council on the 20th day of July, 2010, by the following vote:
