RESOLUTION NO. 2010 - 52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF A 15' OVERFLOW
EASEMENT SHOWN ON THE MAP OF BROOKS VALLEY SUBDIVISION
S-42-90, RECORDED JANUARY 6, 2000, IN BOOK 22 OF MAPS AT PAGE
49, SHASTA COUNTY RECORDS (608 V ALLEYBROOK DRIVE; A-2-09)
WHEREAS:
A. A 15' overflow easement "F" was dedicated to the City of Redding on the map of
Brooks Valley Subdivision, recorded January 6, 2000, in Book 22 of Maps at Page 49, Shasta
County Records (hereafter called the Easement).
B. The owners of the property have asked that the City vacate a portion of the
Easement, as described in Exhibit A and shown hatched on Exhibit B, attached and made a part
hereof by reference, as it has been superceded by relocation and is no longer needed for the
purposes for which it was dedicated.
C. The Engineering Division of the Transportation and Engineering Department has
advised the City Council that there are no in-place public utility facilities that are in use or would
be affected by the proposed vacation, and that the portion of the Easement, as described in
Exhibit A and shown hatched on Exhibit B, is not required for public use.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2.
The City Council approves the request to summarily vacate a portion of the 15' overflow
easement "F" dedicated to the City of Redding on the map of Brooks Valley Subdivision,
recorded January 6, 2000, in Book 22 of Maps at Page 49, Shasta County Records, as
described in Exhibit A and shown hatched on Exhibit B.

3. The easement being vacated has been superceded by relocation and is not needed for the
purposes for which it was dedicated; it is not required; and there are no public facilities
located therein. Therefore, from and after the date this resolution is recorded, that portion
of the 15' overflow easement "F," as described in Exhibit A and shown hatched on
Exhibit B, shall be vacated in its entirety and no longer constitute an easement for
overflow purposes.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.

in Book 22 of Maps at page 49 Shasta County Records situate in the West one-half of Section 19,
T.32N.,; RAW., M.D.M. more particularly described as follows:
Beginning at the Southeast comer of said lot 2 thence along the South line of said Lot 2
S69013' l4"W 59.61 feet; thence N81 035'06"W 30.75 feet to a point on the North line of said
easement 'F'; thence along said easement line N69013'14"B 88.37 feet to a point on the West
right of way oEValley Brook Drive as shown on said map; thence along said right of way on a
curve concave to the West which tangent bears S15029'20"B having a radius of220.00 feet, a
central angle of 03056'20" and an arc length of15.12 feet to the point of beginning.
