ORDINANCE NO. 2460 AN ORDINANCE OF THE CITY OF REDDING AMENDING TITLE 2 (ADMINISTRATION AND PERSONNEL), CHAPTER 2.16 (CITY CLERK), BY REPEALING SECTION 2.16.010 AND ADDING NEW SECTIONS 2.16.010 THROUGH 2.20.060, ALL RELATING TO DEFINING AND DESCRIBING THE DUTIES OF THE ELECTED POSITION AND THE ADMINISTRATOR POSITION WHEREAS, in 1975 the City Council passed Resolution No. 75-63 bifurcating the Office of the City Clerk into two separate positions with a designated annual salary for each position: (1) "City Clerk (Elected Official);" and (2) "Administrator;" and WHEREAS, the Redding Municipal Code describes the duties for the elected position of the City Clerk but has never been amended to clarifY the separate and distinct duties of the elected position versus the administrator position; and WHEREAS, it is in the best interest of the City to have the Redding Municipal Code clearly define the respective roles and duties of the elected versus the appointed positions associated with the City Clerk for the City of Redding. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Title 2 (Administration and Personnel), Chapter 2.16 (City Clerk), section 2.16.010, is hereby repealed and replaced with the new sections 2.16.010 through 2.16.060 to read as follows: 2.16.010 Office of City Clerk - Compensation. The office of City Clerk is established and shall be supervised by the City Clerk as an elected part-time position. The compensation of the City Clerk shall be fixed by resolution of the City Council adopting a salary schedule reflecting salary for the position at the same rate and with the same benefit level as established for and enjoyed by members of the City Council. 2.16.020 Administrator of the Office of the City Clerk - Compensation. The Administrator of the Office of the City Clerk shall be appointed by the City Manager in accordance with personnel rules and regulations. The Administrator of the Office of the City Clerk, upon appointment by the City Manager, shall receive such compensation as is set forth in the salary schedule adopted by resolution of the City Council pertaining to the position. ~ o .... .- .. Employees of the Office of the City Clerk responsible for fulfilling duties as clerk to the Redding City Council shall be so designated within City budget documents and personnel records. Employees of the Office of the City Clerk shall be jointly appointed by the City Clerk and the Administrator of the Office of the City Clerk. Employees may be assigned to joint service in the Office of the City Clerk and the Administrator of the Office of the City Clerk upon terms acceptable to the City Clerk and the Administrator of the Office of the City Clerk. The City Clerk and Administrator of the Office of the City Clerk shall establish employment standards for employees. 2.20.030 Deputies. The City Clerk may appoint as a deputy one or more employees of the Office of the City Clerk responsible or partially responsible for fulfilling the function and carrying out the duties prescribed in section 2.20.040. The Administrator of the Office of the City Clerk may be appointed as a deputy. 2.20.040 Duties of City Clerk. A. The City Clerk shall keep an accurate record of the minutes and proceedings of the City Council in books bearing appropriate titles and devoted exclusively to such purposes. B. The City Clerk shall keep a book marked "ordinances" and record in it all City ordinances with a certificate annexed to each, stating: The City Clerk shall keep a book marked "ordinances" and record in it all City ordinances with this certificate annexed to each, stating: (a) It is a true and correct copy ofa City ordinance. (b) The ordinance number. (c) It has been published or posted pursuant to law. C. The City Clerk is the custodian of the City seal. D. The City Clerk and his or her deputies may administer oaths or affirmations and take and certifY affidavits and depositions pertaining to City affairs and business which may be used in any court or proceedings in the state. The acknowledgment of an instrument may be made before a city clerk and his or her deputies within the city in which they were elected or appointed. E. The City Clerk shall serve as the City's election official. 2.20.050 Duties of the Administrator of the Office of the City Clerk. The Administrator of the Office of the City Clerk shall be responsible for managing and processing all official public records and business records of the City of Redding and carrying out all tasks assigned by the City Manager and the City Council for which responsibility is not specifically allocated to the City Clerk pursuant to section 2.20.040. Such areas of responsibility include, but are not limited to: administration of the City's business license programs, the tracking of contracts awarded by competitive bid and compliance with requirements of all public contracts, establishment and oversight for maintaining a record retention schedule, serving as the filing official for the City and its affiliated agencies for purposes of compliance with the Fair Political Practices 2 _.~J- . ."'..,........ . . Act, responsibility for the reservation and use of City facilities within the City Hall complex, and functioning as a City department head under the City Manager contributing and participating in the executive management of the City. 2.20.060 Cooperation between the City Clerk and Administrator of the Office of the City Clerk. The City Clerk and Administrator of the Office of the City Clerk shall cooperate in order to assure the prudent management of the City's official records. Section 2. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 3. This ordinance shall take effect thirty (30) days after the date of its adoption, and the City Clerk shall certify to the adoption thereof and cause its publication according to law.
