ORDINANCE NO. 2454 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDDING, AMENDING ORDINANCES ESTABLISHING AND AMENDING CERTAIN LIMIT A TIONS WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE CANBY-HILLTOP-CYPRESS REDEVELOPMENT PROJECT AREA WHEREAS, the City Council of the City of Redding adopted Ordinance No. 1552 on July 20, 1981, as amended by Ordinance No. 1942 on November 6, 1990, Ordinance No. 2104 on December 20, 1994, Ordinance No. 2255 on July 20, 1999, Ordinance No. 2295 on June 18,2002, and Ordinance No. 2332 on July 6,2004, establishing the Redevelopment Plan (the "Redevelopment Plan") for the Canby-Hilltop-Cypress Redevelopment Project; and WHEREAS, the Redding Redevelopment Agency (the "Agency") has been designated as the official redevelopment agency to carry out in the City of Redding the functions and requirements of the Community Redevelopment Law of the State of California (Health and Safety Code Section 33000 et seq.) and to implement the Redevelopment Plan; and WHEREAS, Health and Safety Code Section 33333.6 established certain limitations on the incurring and repaying of indebtedness and the duration of redevelopment plans, which limitations apply to every redevelopment plan adopted on or before December 31, 1993; and WHEREAS, Ordinance No. 2104, adopted on December 20, 1994, extended the time limit on the establishment of loans, advances, and indebtedness, as set forth in the last paragraph of Section 602 ofthe Redevelopment Plan, to January 1,2004, for the Original Area and November 6, 20 10, for the Amended Area; and WHEREAS, Senate Bill 211, effective January 1,2002, amended Health and Safety Code Section 33333.6 to provide that redevelopment agencies may eliminate the time limit on the establishment of loans, advances, and indebtedness contained in redevelopment plans for project areas adopted on or before December 31, 1993, by enacting an ordinance without complying with normal Community Redevelopment Law plan amendment procedures. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING, DOES HEREBY ORDAIN AS FOLLOWS: Section I. The time limit to incur loans, advances, and indebtedness with respect to both the Original and Amended Project Areas set forth in Section 602 of the Redevelopment Plan for the Canby-Hilltop-Cypress Redevelopment Project is hereby repealed. Section 2. This Ordinance amending the Redevelopment Plan is adopted pursuant to Health and Safety Code Section 33333.6(e)(2)(B). ~ --C Section 3. The passage of this ordinance is not a "project" according to Section I 5378(b)(4) of California Environmental Quality Act Guidelines and, therefore, is not subject to the provisions requiring environmental review. '.......~ ,. . . Section 4. The City Clerk is hereby directed to send a certified copy of this Ordinance to the Agency. Section 5. Effective Date. This Ordinance shall be in full force and effect thirty (30) days after its passage. Section 6. Publication. The City Clerk is hereby ordered and directed to certifY to the passage of this Ordinance and to cause the same to be published once in the Record Searchlight, a newspaper of general circulation, published and circulated in the City of Redding, California. Section 7. Severabilitv. If any part of this Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance, and this City Council hereby declares that it would have passed the remainder of this Ordinance, if such invalid portion thereof had been deleted.
