RESOLUTION NO. 2010 - 33
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
APPROVING THE USE OF TAX INCREMENT FUNDS TO CONSTRUCT
INFRASTRUCTURE IMPROVEMENTS ON BUENAVENTURA
BOULEVARD BETWEEN RAILROAD A VENUE AND STATE ROUTE 273
WITHIN THE MARKET STREET REDEVELOPMENT PROJECT AREA
WHEREAS, the Redding Redevelopment Agency desires to contribute tax increment funds
from the Market Street Redevelopment Project Area to assist with improvements to Buenaventura
Boulevard between Railroad Avenue and State Route 273 consisting of widening Buenaventura
Boulevard to provide an additional travel lane in each direction, as well as eight-foot paved shoulders
with a bike lane, construction of curb, gutter, and sidewalk, storm drain facilities, and providing a
second northbound left-turn lane on State Route 273, restriping, and upgrading the existing traffic
signals to accommodate the new lane configurations; and
WHEREAS, Section 33445(a) of the California Health and Safety Code states that the
Agency may pay all, or part of, the value of land for and the cost of construction of any building,
facility, structure, or other improvement that is publicly owned and is located inside, or contiguous
to, the project area, if the legislative body determines: (I) that the acquisition of land or the
installation or construction of the buildings, facilities, structures, or other improvements that are
publicly owned are of benefit to the project area by helping to eliminate blight within the project area
or providing housing for low- or moderate-income persons; (2) that no other reasonable means of
financing the acquisition of the land or installation or construction of the buildings, facilities,
structures, or other improvements that are publicly owned, are available to the community; and
(3) that the payment of funds for the acquisition ofland or the cost of buildings, facilities, structures,
or other improvements that are publicly owned is consistent with an adopted implementation plan;
and
WHEREAS, Section 33678 of the California Health and Safety Code states that the use of
tax increment funds for public improvements must primarily benefit the project area; and
WHEREAS, the City Council is the legislative body for the City of Redding.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES
HEREBY RESOLVE, DETERMINE, AND FIND AS FOLLOWS:
1. The Analysis of the Proposed Use of Redevelopment Funds, attached and
incorporated herein, are adopted in satisfaction ofthe requirements set forth in California Health and
Safety Code Sections 33445(a) and 33678.
2. The construction of the public improvements is of benefit to the Project Area by
helping to eliminate blight within the Market Street Project Area.
3. The public improvements are of primary benefit to the Market Street Project Area.

4. There are no other reasonable means offinancing the public improvements available
to the community.
5. The payment of funds for the cost of the public improvements is consistent with the
adopted Implementation Plan.
I HEREBY CERTIFY that the foregoing resolution was introduced and read at a regular
meeting of the Redding City Council on the 16'h day of March, 2010, and was duly adopted at said

ANALYSIS OF THE PROPOSED USE OF REDEVELOPMENT FUNDS
WIDENING OF BUENA VENTURA BOULEVARD AT STATE ROUTE 273
The Redding Redevelopment Agency (Agency) is proposing to provide up to $100,000 in
redevelopment funds to assist in the widening of Buena ventura Boulevard at State Route 273. The
construction of these improvements is part of the City of Redding's (City) project to widen
Buenaventura Boulevard between State Route 273 and the Railroad A venue intersection, as well as
improvements to State Route 273 to accommodate the new lane configurations (the Project). The
Project is located within the Market Street Redevelopment Project Area (Project Area), the location
of which is depicted on the attached Exhibit 1.
Buenaventura Boulevard is a key east-west transportation corridor in the southern portion of the City,
while State Route 273 serves as a primary route between Redding and Anderson. Congestion within
the Buenaventura Boulevard corridor during the peak commuting hours reaches an unacceptable
Level of Service "E." In November 2008, the City Council accepted funding from the Highway
Safety Improvement Program (HSIP) in an amount not-to-exceed $708,750 to widen Buenaventura
Boulevard between State Route 273 and the Railroad A venue intersection. In addition, in November
2009, the City Council authorized a Cooperative Agreement with Caltrans for $450,000 in State
Highway Operation Protection Program (SHOPP) Minor A funds from the State's 2009-10 budget
to improve State Route 273 to include a second northbound left-turn lane, restriping, and upgrading
of the existing traffic signals to accommodate the new Buenaventura Boulevard lane configurations.
With the work being undertaken as one project, efficiencies are maximized and the inconvenience
to the public minimized.
As proposed, the Agency will contribute up to $100,000 of its tax increment revenues from the
Market Street Project toward the cost of constructing improvements associated with the Project.
These improvements, estimated at $1,270,750, consist of widening Buenaventura Boulevard to
provide an additional lane in each direction between State Route 273 and Railroad Avenue, eight-
foot paved shoulders with a bike lane, storm drain facilities, construction of curb, gutter, and
sidewalk, and a second northbound left-turn lane on State Route 273, along with restriping and
upgrading the existing traffic signals to accommodate the new Buenaventura Boulevard lane
configurations.
California Health and Safety Code Section 33445(a) authorizes an agency to pay all or a part of the
value of the land for and the cost of the installation and construction of any building, facility,
structure, or other improvement that is publicly owned and is located inside or contiguous to the
project area, if the legislative body determines all of the following:
I. That the acquisition of land or the installation or construction of the buildings, facilities,
structures, or other improvements that are publicly owned are of benefit to the project area
by helping to eliminate blight within the project area or providing housing for low- or
moderate-income persons;

2. That no other reasonable means of financing the acquisition of the land or installation or
construction of the buildings, facilities, structures, or other improvements that are publicly
owned, are available to the community; and
3. That the payment of funds for the acquisition of land or the cost of buildings, facilities,
structures, or other improvements that are publicly owned is consistent with an adopted
implementation plan.
Section 33678 of the California Health and Safety Code adds the requirement that if tax increment
money is used, the project must meet the definition and purpose of "redevelopment" as prescribed
in Sections 33020 and 33021 and primarily benefit the project area from which the tax increment
money is derived. These issues are discussed below by topic:
Does the Project meet the definition and purpose of Redevelopment and are the proposed public
improvement of primary benefit to the Market Street Project Area?
Sections 33020 and 33021 define "redevelopment" as the planning, development, replanning,
redesign, clearance, alteration, improvement, modernization, reconstruction orrehabilitation, or any
combination of these, of all or a part of a survey area. Redevelopment also includes the provision
for open-space types of uses, such as streets and other public grounds and space around buildings,
and public or private buildings, structures and improvements, and improvements of public or private
recreation areas and other public grounds.
The proposed improvements meet the definition of redevelopment through the provision of public
improvements which enhance open-space type uses in the area, i.e., street improvements.
Additionally, the Project will be of primary benefit to the Market Street Project Area through
increased capacity of a major arterial, as well as improvements benefitting both pedestrian and
bicycle traffic through the construction of a bike lane and curb, gutter, and sidewalk.
Are they any other reasonable means offinancing the proposed improvements available to the
community?
The engineer's estimate forthe Project is $1 ,270,750. Proposed funding for the Project is as fo\1ows:

Other than utilizing tax increment funds from the Agency, the City has no other reasonable means
available to fund the proposed improvements as:
The City's General Fund has been severely impacted by the global economic recession;
The Project does not qualifY for State Transportation Improvement Program (STIP) funds;
and
While the Project is eligible to receive Traffic Impact Fee (TIF) funding, due to the amount
of available funding and other priority projects, it would be a number of years before the
funding could be provided.
Will the construction of the public improvements help in the elimination of one or more blighting
conditions within the Market Street Project Area? Is the Project consistent with the
Implementation Plan adopted for the Project Area?
The Blight Analysis conducted at the time the Project Area was amended in ]990 identified both
physical and economic blight as blighting conditions within the Project Area. The Project, as
designed, will assist in the elimination of physical blight through the redesign and improvement of
inadequate public infrastructure, and provision of curb, gutter, sidewalk (including 275 lineal feet
fronting Agency-owned property), and a bicycle lane. Additionally, the Project has the potential of
eliminating economic blight through the stimulation of private development of underutilized
properties and/orthe redevelopment of blighted properties in the immediate vicinity of the proposed
Project.
The 20]0-20]4 Implementation Plan (lmp]ementation Plan) for the Market Street Redevelopment
Project Area, adopted November] 6, 2009, was prepared and adopted pursuant to Health & Safety
Code Section 33490. The Implementation Plan specifically describes the Agency's involvement
relative to street improvements to improve circulation and replace inadequate infrastructure. The
Agency activities identified in this category include the removal and replacement of inadequate
infrastructure and installation of curb, gutter, and sidewalk.
Further, the Implementation Plan contains specific goals and objectives relative to the elimination
of blight within the Project Area. The proposed activity is consistent with and supports the goal of
eliminating blighting influences in the Project Area, including, among others: inadequate public
improvements, facilities, and utilities.
In summary, the Redevelopment Plan for the Project Area adopted in ]990 identified the need to
improve the public infrastructure within the Project Area. The Five-Year Implementation Plan for
the Project Area adopted by the Agency on November] 6, 2009, specifically identifies the need to
remove and replace inadequate infrastructure, construct new and/or realigned streets, and install curb,
gutter, and sidewalk. Thus, the Project is consistent with the Implementation Plan. Additionally,
construction of the improvements will help remove contributors to blight through potential
stimulation of development of properties and addressing inadequate public infrastructure in the
Market Street Project Area.
