RESOLUTION NO. 2009 - 187 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE STATEMENT OF FINDINGS FOR THE OASIS ROAD INTERCHANGE IMPROVEMENT PROJECT: PHASE I WHEREAS, the City of Redding, as lead agency pursuant to the California Environmental Quality Act (CEQA) for the Oasis Road Specific Plan Master Environmental Impact Report and the Oasis Road Interchange Improvement Project: Phase I (Project), has conducted the following environmental review for the proposed Project: I. A Master Environmental Impact Report (MEIR) for the Oasis Road Specific Plan was prepared and certified by the Redding City Council on June 6, 2006; and 2. A Notice of Determination for the Oasis Road Specific Plan MEIR was approved on September 19,2006; and 3. An Initial Study was prepared for the Oasis Road Interchange Improvement Project: Phase I on October 22,2009; and WHEREAS, the Oasis Road Interchange Improvement Project: Phase I is a subsequent project within the scope of the Oasis Road Specific Plan MEIR; and WHEREAS, a Mitigation Monitoring and Reporting Program as required by CEQA is included in the Oasis Road Specific Plan MEIR and, thus, included in the Oasis Road Interchange Improvement Project: Phase I, as applicable; and WHEREAS, written Findings, incorporated herein by attachment, must be developed by the approving body as required by CEQA; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redding, based upon substantial evidence in the administrative record and the Initial Study for the Oasis Road Interchange Improvement Project: Phase I, in compliance with the California Environmental Quality Act, hereby: 1. Approves the Statement of Findings for the Oasis Road Interchange Improvement Project: Phase 1. 2. Authorizes staff to prepare a Public Notice reflecting the City's action. 3. Authorizes staff to prepare a Notice of Determination at the end of the public comment period, as applicable. OASIS ROAD INTERCHANGE IMPROVEMENT PROJECT: PHASE 1 SCH NO. 2000062144 STATEMENT OF FINDINGS INTRODUCTION A Master Environmental Impact Report (MEIR) was prepared for the Oasis Road Specific Plan (ORSP) and certified by the Redding City Council on June 6, 2006. The California Environmental Quality Act (CEQA) allows for preparation of an MEIR for certain projects which will form the basis for future decision making, such as for a specific plan or for projects consisting of smaller individual projects which will be carried out in phases. Once the MEIR is prepared and certified, subsequent projects which are determined to be within the scope of the MEIR will be subject only to limited environmental review. A new environmental document is not required provided that: 1. The lead agency for the subsequent project is the lead agency or any responsible agency identified in the MEIR. 2. The lead agency for the subsequent project prepares an Initial Study on the proposal. The Initial Study shall analyze whether the subsequent project was described in the MEIR and whether the subsequent project may cause any additional significant effect on the environment which was not previously examined in the MEIR. 3. The lead agency for the subsequent project determines on the basis of written findings that no additional significant environmental effect will result from the proposal, that no new additional mitigation measures or alternatives may be required, and that the project is within the scope of the MEIR. "Additional significant environmental effect" means any project-specific effect which was not addressed as a significant effect in the MEIR. Whether a subsequent project is within the scope of the MEIR is a question off act to be determined by the lead agency based upon a review of the Initial "Study. The Initial Study determines whether there are additional significant effects or new additional mitigation measures or alternatives required for the subsequent project that are not already discussed in the MEIR. PROJECT DESCRIPTION Phase I of the Oasis Road Interchange Improvement Project involves construction of the first phase of improvements as described in the Project Study Report, the ORSP, and the MEIR. The project involves widening the northbound off-ramp, realigning the southbound off-ramp, and adding a southbound loop on-ramp. No new right-of-way is needed for the project. All work will occur within existing Caltrans right-of-way. There are no wetlands, sensitive species or their habitats, or other sensitive biological resources within the project environmental study limits. FINDINGS The City of Redding, having reviewed and considered the information contained in the MEIR, the public record, administrative record, and the Initial Study, finds, pursuant to Public Resources Code Section 21157 and Title 14 of the California Code of Regulations, Section 15177 (State CEQA Guidelines), the following: 1. The City of Redding is the lead agency for the project and was the lead agency for the MEIR. 2. The City of Redding prepared an Initial Study which determined that the project was described in the MEIR and that the project does not cause any additional significant effect on the environment which was not previously examined in the MEIR. 3. The City of Redding has determined that no additional significant environmental effect will result from the project, no new additional mitigation measures or alternatives will be required, and the project is within the scope ofthe MEIR.
