RESOLUTION NO. 2009 - 153 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING THE GENERAL PLAN DIAGRAM OF THE CITY BY ADOPTING GENERAL PLAN AMENDMENTS GPA-7-03 AND GPA-3-04, INVOLVING PROPERTIES IDENTIFIED AS ASSESSOR'S PARCEL NO. (APN) 203-160-019, 16989 CAMPO CALLE, 950, 959, 960, 979, 980, AND 985 CANYON CREEK ROAD, WHICH CONSIST OF THE REMOVAL OF THE PLANNED EXTENSION OF CANYON CREEK ROAD, THE MODIFICATION OF THE PRIMARY GROWTH BOUNDARY, AND CHANGING THE LAND USE DESIGNATION FROM "RESIDENTIAL, 1 TO 5 ACRES" TO "RESIDENTIAL, 2 TO 3.5 UNITS PER ACRE" (GPA-7-03 AND GPA-3-04). WHEREAS, following the required public hearing, the City Council of the City of Redding determined that the General Plan Diagram be amended by incorporating therein the changes contained in General Plan Amendments GP A-7-03 and GP A-3-04, involving properties identified as Assessor Parcel Number (APN) 203-160-019, 16989 Campo Calle, 950, 959, 960, 979, 980, and 985 Canyon Creek Road, and 11106 Campers Court as follows: GPA-7-03 and GPA-3-04 1. The removal of the planned extension of Canyon Creek Road from properties identified as APN 203-160-019, 16989 Campo Calle and 950, 959, 960, 979, 980, and 985 Canyon Creek Road. 2. Modify the Primary Growth Boundary to include properties identified as APN Nos. 203-160-019 and-00l,204-440-004,005,and013, 16929,16935, 16936,16942, 16943, 16945, 16946 Campo Calle and 5013 Placer Road. 3. Changing the land use designation on a 1 0.6-acre portion of APN No. 203-160-019 and a 14-acre portion of 16989 Campo Calle from "Residential, I to 5 acres" to "Residential, 2 to 3.5 dwelling units per acre." WHEREAS, following the required notice in accordance with law, the City Council held a public hearing and carefully considered the evidence at the hearing; and WHEREAS, the street design of the proposed Westridge III and Westridge II Subdivisions will satisfy the intended purposes of the Canyon Creek Road extension by providing additional public- street access to the Country Heights Subdivision and connection to Placer Street; and WHEREAS, it is the intent of the Council at a subsequent hearing to consider dissolving the Canyon Creek Road Traffic Impact District and address disposition of collected fees in accordance with Chapter 16.20 of the Redding Municipal Code; WHEREAS, the City Council, at the conclusion of its June 19, 2007, hearing, adopted City Council Resolution No. 2007-120, certifying FEIR-2-03 and adopting the Mitigation Monitoring Program. Notice of that hearing included a letter to all public agencies and persons that submitted comments GPA-7-U3 and GPA-3-04-RFEIR. Westridge Page Iof2 &5 o '1 "" ~ . . on the DEIR and to all property owners within 1,000 feet from the project boundary and publication in the Record Searchlight; and WHEREAS, the City Council, at the conclusion of its June 19,2007, hearing, adopted City Council Resolution No. 2007-124 amending the General Plan Diagram of the City of Redding approving General Plan Amendments GP A-7-03 and GP A-3-04 for the Westridge Master Plan, Westridge II Subdivision, and Westridge III Subdivision. WHEREAS, the City Council, at the conclusion of its January 20, 2009, hearing, adopted City Council Resolution No. 2009-0 I, rescinding and setting aside actions taken in June 2007 pertaining to the certification of Final Environmental Impact Report EIR -2-03, the endorsement of Annexation Application AN-I-04; approval of General Plan Amendment Applications GP A-7-03 and GP A-3-04; approval of Rezoning Application RZ-II-03; approval of Tentative Subdivision Map Applications S-4-04 and S-19-03; and the park fee credit agreement for the Westridge project. WHEREAS, FEIR-2-03 has been revised pursuant to the court order issued in Friends of Canyon Creek v. Greenview Development, et al. WHEREAS, the Revised Final EIR was certified as complying with the requirements of the California Enviromnental Quality Act on July 21, 2009; and NOW, THEREFORE, IT IS RESOLVED that the City Council, having reviewed and approved the Revised Final Environmental Impact Report EIR-2-03, stating that with mitigation the Westridge Master Plan project has no substantial impact upon the enviromnent, hereby amends the General Plan Diagram of the City of Redding by incorporating therein the changes contained in General Plan Amendments GP A-7-03 and GP A-3-04, as shown on the maps attached and made a part hereof. IT IS FURTHER RESOLVED, by the City Council of the City of Redding that this resolution shall not have the force and effect of law and shall not become effective unless and until Ordinance No. 2437 shall be introduced, adopted, and thereafter becomes legally effective pursuant to the terms provided for in that ordinance.
