RESOLUTION NO. 2009 - 71 LANDSCAPE MAINTENANCE DISTRICT "A" (Miscellaneous) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO: (1) SET A PUBLIC HEARING DATE RELANDSCAPE MAINTENANCE DISTRICT "A." (2) LEVY AND COLLECT ASSESSMENTS IN DISTRICT "A" FOR FISCAL YEAR 2009-10 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District" A" (District) under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval ofBonnyview Estates, Units I and 2, generally located at the intersection of Pioneer Lane and East Bonnyview Road; Candlewood Estates, Units I and 2, generally located west of Shasta View Drive at Atrium Way; Hidden Hills, Units 1,2 and 3, generally located west of Chum Creek Road at Rolling View Drive; Highland Oaks, Units I, 2, and 3, generally located west ofthe intersection of Shasta View Drive and Western Oak Drive and west of the intersection of Shasta View Drive and Castlewood Drive; La Riconada Estates, Units I and 2, generally located at the east end ofEI Verano Street; Lancer Hills, Units 2, 3 and 4, generally located west of Browning Street at Lancers Lane; Quail Ridge Estates, Units 4,5,7, and 8, generally located near the intersection of Lancers Lane and Chum Creek Road; Ravenwood Estates, Units 1,2,3,4,5,6,7,8, 8A" 9,10, and 17, generally located near the intersection of Old Alturas Road and Shasta View Drive; River Heights generally located south of the intersection of Hilltop Drive and River Bend Road; River Park Highlands, Units 1,2,3,4,5, 6, and 7, generally located near River Park Drive north of Benton Drive; River Ridge Park, Units 1,2,3,4, and 5, generally located south of the intersection of Quartz Hill Road and River Ridge Drive; River Ridge Terrace, Units 1,2, and 3, generally located south of Quartz Hill Road along Spinnaker Drive; Victor Estates, Units I and 2, generally located East of Victor Avenue across from Enterprise Park; Vista Ridge, Units I and 2, generally located north of Tanglewood Drive; Western Acres, Unit I, generally located west of the intersection of Shasta View Drive and Pacific Avenue; Westside Estates, generally located east of the intersection of Placer Street and Boston A venue; and White Hawk Estates, Unit 2, generally located south of the intersection of Cumberland Drive and Dream Street. & o .-Q \ ~ --.... .' . . C. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. D. This Resolution is made in satisfaction of those requirements set forth in the Streets and Highways Code Section 22624. NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: I. The matters set forth above are true, correct, and are adopted herein. 2. Pursuant to the Streets and Highways Code 922623, the Report of the Engineer, as filed, is hereby approved. 3. The Report ofthe Engineer, on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the assessable lots and remaining parcels within the District. 4. The existing improvements for each subdivision in the District are set forth in Part E of the Engineer's Report, on file with the City Clerk, under the column entitled "Improvements." 5. The general locations of the lots and remaining parcels in the District are set forth in Part A of the Engineer's Report, on file with the City Clerk. 6. Only costs for the maintenance oflandscaping; miscellaneous lighting; mulching; vandalism; repairs to the irrigation system; electric and water charges; replacement of vegetation as necessary; removal oftrimmings, rubbish, and debris; maintenance of the detention basin; and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 7. A public hearing will be held on Tuesday, July 21,2009, at the hour of7 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress A venue, Redding, California, to address the confirmation and approval of the proposed assessment for Fiscal Year 2009-10. The proposed assessment for Fiscal Year 2009-10 is $29.46 (not an increase from the previous year), it being the intention of the Council to levy said assessment in the amount of$29.46 for Fiscal Year 2009-10. 8. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways Code Section 22626(a). . .
