RESOLUTION NO. 2009 - 29
A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE
USE OF TAX INCREMENT FUNDS TO CONSTRUCT INFRASTRUCTURE
IMPROVEMENTS A TTHE SOUTH SIDE OF LEILAA VENUE AND THE INTERSECTIONS
OFBEVERL Y DRIVE AND RAMONA PLACE WITHIN THE CANBY-HILL TOP-CYPRESS
REDEVELOPMENT PROJECT AREA.
WHEREAS, the Redding Redevelopment Agency desires to contribute tax increment funds from the Canby-
Hilltop-Cypress Redevelopment Project to help construct infrastructure improvements at the south side of Leila Avenue
and the intersections of Beverly Drive and Ramona Place; and
WHEREAS, Section 33445 of the California Health and Safety Code states that the Agency may pay all or
part of the costs of a public improvement if the legislative body determines that the improvement will benefit the
Project from which the funds are derived, that there are no other reasonable means of financing the improvement, and
that the project will assist in the elimination of blight; and
WHEREAS, Section 33678 of the California Health and Safety Code states that the use of tax increment funds
for public improvements must primarily benefit the project area; and
WHEREAS, the City Council is the legislative body for the City of Redding.
NOW, THEREFORE, the City Council FINDS, RESOLVES, and ORDERS as follows:
1. The Analysis of Findings, attached and incorporated herein, are hereby adopted in satisfaction of the
requirements set forth in California Health and Safety Code Sections 33445 and 33678.
2. The public improvement is of primary benefit to the Canby-Hilltop-Cypress Redevelopment Project
Area.
3. There are no other reasonable means of financing the public improvement available to the community.
4. The payment of funds for the public improvement will assist in the elimination of one or more blighting
conditions in the Project Area and is consistent with the adopted Implementation Plan.
I HEREBY CERTIFY that the foregoing resolution was introduced and read at a regular meeting of the
Redding City Council on the 21st day of April, 2009, and was duly adopted at said meeting by the following vote:

ANALYSIS OF FINDINGS
LEILA AVENUE/BEVERLY DRIVE/RAMONA PLACE INFRASTRUCTURE
IMPROVEMENTS
The Redding Redevelopment Agency (Agency), as lead agency, desires to utilize tax increment funds
from the Canby/Hilltop/Cypress Redevelopment Project Area (Project Area) to construct infrastructure
improvements along the south side of Leila Avenue from 2402 Leila Avenue to 2580 Bechelli Lane
and at the intersections of Beverly Drive and Ramona Place. The purpose of the improvements is to
create a safe pedestrian access for residents and improve the drainage system along this neighborhood
access street in the Cypress Subdivision, which is within the Project Area. Agency funds will not be
used for the design of the improvements, as Community Development Block Grant funds have been
secured and expended for that portion of the project.
As depicted on the attached Exhibit A, the proposal includes the construction offollowing:
. Installation of curb, gutter, and sidewalk along the south side of Leila Avenue from the
northwest comer of 2402 Leila Avenue to Beverly Drive. To facilitate the installation of the
curb, gutter, and sidewalk, a 370-square-foot retaining wall and 143 lineal feet of chain link
fencing will be installed;
. Installation of a curb, gutter, sidewalk, and ADA curb ramps along the south side of Leila
Avenue from Beverly Drive to Ramona Place;
. Installation of a curb, gutter, sidewalk, and an ADA curb ramp along the south side of Leila
Avenue from Ramona Place to the northwest comer of2580 Bechelli Lane; and
. Installation of a valley gutter at the north end of Ramona Place.
Health and Safety Code Section 33445 stipulates that in order for the Agency to pay all or part of the
costs of any public improvement, the City Council must determine that the improvement is of benefit
to the project area from which the funds are derived or to the immediate neighborhood in which the
project is located; that no other reasonable means of financing the improvement is available to the
community; and that the payment of funds for the improvement will assist in the elimination of one or
more blighting conditions in the project area, and is consistent with an adopted implementation plan.
Health and Safety Code Section 33678 adds to the above that if tax increment money is used, the
improvement must be of primary benefit to the project area.
Is the proposed improvement of primary benefit to the Project Area?
The proposed project will complement the infrastructure improvements completed in 2004, by the
Agency in conjunction with the development of Laurel Glen Apartments (Laurel Glen), and complete
the sidewalk and associated drainage improvements from the east side of Laurel Glen to Bechelli Lane.
Pedestrian traffic traveling through the Project Area and, more specifically Cypress Subdivision
residents, will utilize the new improvements to safely access Cypress Avenue and Bechelli Lane, two
main linkage streets. Minor storm drain improvements will correct deficiencies in public facilities at
the south side of Leila Avenue.
The primary benefits to the Project Area which will assist in eliminating blight are: (a) improved
pedestrian circulation and safety; and (b) improvement of the storm drain system. The end result of the
project will provide a safe path of travel for pedestrians and storm water runoff will be directed and
distributed to the public storm drain system.

Are any other reasonable means of financing available to the community to fund the improvements?
The Agency was successful in obtaining a total of $105,000 in grant funding from the Community
Development Block Grant Program for design ($55,000) and construction ($50,000) of the proposed
improvements. However, the City's Capital Improvement Plan for fiscal years 2007/2008 through
201212013 does not identifY the project or any funding source that could be used to contribute toward
the project within the next five years. The project would not be competitive for the receipt of State
Transportation Improvement Program (STIP) funds and there are no other City funds available for this
project at this time.
Will the proposed project assist in the elimination of one or more blighting conditions within the
CanbylHilltop/Cypress Redevelopment Project Area? Is the proposed project consistent with the
Implementation Plan adopted for the Project Area?
Construction of the improvements will help remove contributors to blight by addressing pedestrian
safety issues, correcting deficiencies of the public storm drain system, and encouraging private
development in the Project Area.
The Redevelopment Plan for the Project Area identifies the need for residential neighborhood street
improvements. The Project Area's Five-Year Implementation Plan, adopted by the Agency in
November 2004, specifically identifies Neighborhood Improvements, such as curb, gutter, and
sidewalk installation and construction of the associated storm drain improvements, as eliminating
blight. Thus, installation of the proposed improvements are consistent with the Implementation Plan
adopted for the Project Area and will assist in the elimination of one or more blighting conditions as
identified in the Redevelopment Plan.
