RESOLUTION NO. 2009 - 24
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF A 15-FOOT-WIDE
EASEMENT FOR SEWER PURPOSES GRANTED TO THE CITY BY AN
EASEMENT DEED FROM T. R. WOODS TO THE CITY OF REDDING,
RECORDED JULY 10, 1958, IN BOOK 571 OF OFFICIAL RECORDS AT
PAGE 81, SHASTA COUNTY RECORDS. (520 OVERHILL DRIVE;
A-I-09).
WHEREAS:
A. This portion of a 15-foot-wide easement for sewer purposes, lying within the
property located at 520 Overhill Drive, was granted to the City by an easement deed from
T. R. Woods to the City of Redding, recorded July 10, 1958, in Book 571 of Official Records at
Page 81, Shasta County Records (hereafter called the Easement).
B. The owners of the property have asked that the City vacate that portion of the
Easement as described in Exhibit A and shown hatched in Exhibit B, attached and made a part
hereof by reference, as it has been superceded by relocation and is no longer needed for the
purposes for wl1ich it was granted.
C. The Engineering Division of the Transportation and Engineering Department has
advised the City Council that there are no in-place public utility facilities that are in use or would
be affected by the proposed vacation and that the Easement is not required for public use.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:
1. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2. The City Council approves the request to summarily vacate that portion ofa l5-foot-wide
easement for sewer purposes lying within the property located at 520 Overhill Drive,

granted to the City by an easement deed from T. R. Woods to the City of Redding,
recorded July 10, 1958, in Book 571 of Official Records at Page 81, Shasta County
Records, more particularly described in Exhibit A and shown hatched in Exhibit B.
3. The easement being vacated has been superceded by relocation and is not needed for the
purposes for which it was granted; it is not required; and there are no public facilities
located therein, Therefore, from and after the date this resolution is recorded, that portion
of a 15-foot-wide easement for sewer purposes, lying within the property located at
520 Overhill Drive, granted to the City by an easement deed from T. R. Woods to the
City of Redding, recorded July 10, 1958, in Book 571 of Official Records at Page 81,
Shasta County Records, more particularly described in Exhibit A and shown hatched in
Exhibit B, shall be vacated in its entirety and no longer constitute an easement for sewer
purposes.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.

That portion of the 15 foot easement for sewer purposes created by an easement deed from T.
R. Woods to the City of Redding, recorded July 10, 1958, in Book 571 of Official Records at
Page 81, Shasta County Records, lying Northeasterly of the following described line:
COMMENCING at the most Southerly corner of Parcel 3 as shown on the map recorded August
9, 1978 in Book 15 of Parcel Maps at Page 121, Shasta County Records; thence on and along the
Easterly line of said Parcel 3, also being the Westerly line of Overhill Drive, through a 725.00 foot
radius curve to the right, the center of which bears South 63042'20" East, having a central angle
of 00047'25" and a length of 10.00 feet; thence leaving said Easterly line, North 63042'20" West,
a distance of 28.85 feet to the TRUE POINT OF BEGINNING, also being a point on the Southerly
line of said 15 foot easement for sewer purposes; thence continuing North 63042'20" West, a
distance of 18.68 feet; thence North 71051'20" West, a distance of 18.52 feet more or less to point
of termination on the Northerly line of said 15 foot easement for sewer purposes.
Containing 792 square feet more or less.
