HomeMy WebLinkAboutOrdinance - 2422 - Redding Power Unit 6 .. . . .:'1 ORDINANCE NO. 2422 AN ORDINANCE OF THE CITY OF REDDING ADOPTING A SPECIAL PROCUREMENT PROCESS FOR CERTAIN EQUIPMENT AND MATERIAL NECESSARY FOR THE CONSTRUCTION OF THE REDDING POWER UNIT 6 PROJECT. WHEREAS, the provisions of California Government Code 99 54201 et seq. require cities to adopt procedures for acquisition of supplies and equipment; and WHEREAS, Chapter 4.20 of the Redding Municipal Code contains the general procedures for the purchase of goods and services for the City, including competitive bidding requirements and dollar threshold limits for approval of contracts by the City Manager; and WHEREAS, on September 2, 2008, the City Council considered and approved the establishment of an alternative procurement strategy for the acquisition of certain equipment and material necessary for the construction of the Redding Power Unit 6 Project; and WHEREAS, it is desirable and necessary to formally adopt an alternative procurement process to implement the procurement strategy for the Redding Power Unit 6 Project. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Notwithstanding any rule or provision oflaw in the Redding Municipal Code to the contrary, the authority to award contracts for the procurement of the specific items specified in the table below is delegated to the City Manager, or his designee, subject to review and approval as to form and legality by the City Attorney. These unique items are all associated with construction of Redding Power Unit 6 and after consultation with the design engineer (Power Engineers, Inc. of Hailey, Idaho), it has been determined that the procurement process set forth in this ordinance will be in the best interest of ratepayers by timely capturing the best blend of competitively bid pricing and the benefits of matching existing equipment. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 3. This ordinance shall take effect 30 days after the date of its adoption, and the City Clerk shall certifY to the adoption thereof and cause its publication according to law.
