RESOLUTION NO. 2008 - 118 LANDSCAPE MAINTENANCE DISTRICT "N" (THE VILLAGES AT SHASTA VIEW GARDENS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING (1) CONFIRMING THE MAPS OF THE ASSESSMENT DISTRICT CONTAINED IN THE ENGINEER'S REPORT. (2) CONFIRMING AND ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS FOR FISCAL YEAR 2008-09 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. On June 17, 2008, by Resolution 2008-76, the City Council approved the Report of the Engineer as filed relating to Landscape Maintenance District "N" (District) and gave notice of the time and place ofthe July 1,2008, public hearing regarding the levy and collection of assessments for Fiscal Year 2008-09. B. A map of the area in the District is attached and made a part hereof. C. The public hearing, duly and properly noticed, commenced at the City Council Chambers, 777 Cypress Avenue, Redding, California on July I, 2008, and was concluded prior to the adoption of this resolution. At the public hearing, the City Council gave every interested person an opportunity to object to the proposed assessments. D. The assessment for Fiscal Year 2008-09 is $51.31, which is not an increase within the meaning of Streets and Highways Code S 22624 and 22630.5, because the cost ofliving adjustment in the amount of $1.59 is pursuant to a methodology approved at the time of the formation of the District. E. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: I. The matters set forth above are true and correct. 2. The maps of the assessment district contained in the Engineer's Report are confirmed. 3. The City Council has considered all oral statements and written protests or communications made or filed by interested persons at the public hearing of July I, 2008, and expressly , - -\- . . overrules any and all protests filed objecting to the proposed annual assessments and levy amount in the District. 4. The City Council finds that the Engineer's Report has fairly and properly apportioned the costs ofthe improvements to each lot/remaining parcel ofland in the district in proportion to the estimated benefits to be received by each lot/remaining parcel ofland from the improvements. 5. An assessment of $51.31 against each developable lot/remaining parcel located within the District for Fiscal Year 2008-09 is confirmed, adopted, and levied except that an assessment shall not be levied on property owned by a Federal or State governmental agency or another local agency. 6. The City Clerk shall forthwith transfer to the Auditor Controller and the Assessor Recorder of Shasta County a certified copy of this resolution and a certified copy of the assessment district maps contained in the Engineer's Report for Landscape Maintenance District "N." 7. That the City Clerk gave notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
