'. ~I RESOLUTION NO. 2008-92 LANDSCAPE MAINTENANCE DISTRICT 07-06 (BUCKEYE PINES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO: (I) SET A PUBLIC HEARING DATE RE LANDSCAPE MAINTENANCE DISTRICT 07-06. (2) LEVY AND COLLECT ASSESSMENTS IN DISTRICT 07-06 FOR FISCAL YEAR 2008-09 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District 07-06 (District) under authority granted by the Landscaping and Lighting Act of1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. 8. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval of the subdivisions contained therein. C. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. D. This Resolution is made in satisfaction of those requirements set forth in the Streets and Highways Code Section 22624. E. The assessment for Fiscal Year 2008-09 is not an increase within the meaning of Streets and Highways Code S22624 and 22630.5 because the cost ofliving adjustment provided for herein was approved at the time of the formation of the District NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: I. The matters set forth above are true, correct, and are adopted herein. 2. Pursuant to the Streets and Highways Code S22623, the Report of the Engineer, as filed, is hereby approved. 3. The Report of the Engineer, on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the assessable lots and remaining parcels within the District. ~ I c.Q J-Y 4. The existing improvements for each subdivision in the District are set forth in Part E of the Engineer's Report, on file with the City Clerk, under the column entitled "Improvements." . . :"i 5. The general locations of the lots and remaining parcels in the District are set forth in Part A of the Engineer's Report, on file with the City Clerk. 6. Only costs for the maintenance oflandscaping; miscellaneous lighting; mulching; vandalism; repairs to the irrigation system; electric and water charges; replacement of vegetation as necessary; removal of trimmings, rubbish, and debris; maintenance ofthe detention basin; and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 7. A public hearing will be held on Tuesday, July I, 2008, at the hour of 7 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the confirmation and approval of the proposed assessment for Fiscal Year 2008-09. The proposed assessment for Fiscal Year 2008-09 is $496.85. 8. The method of calculating the annual assessment is set forth in Part C of the Engineer's Report, on file with the City Clerk, under the column entitled "Assessment District Revenue." 9. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
