Code §6103 A.P.N. 102-190-026, 027, 028, 029, 030, 031, & 035 None IIIIIIIIIIIIIIIIIIIIllllllllllllll- ~eco~ded Official ~eco~cls ~ounty Of CRI~ ~J)~ld~ Re~opder BEC FEE . ~ 1st Page I of 3 RESOLUTION NO. 2004- / / A RESOLUTION OF ]]HE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A 10' SANITARY SEWER EASEMENT, TEMPORARY ROAD & UTILITY EASEMENT, AND A BUILDING EXCLUSION ZONE DEDICATED TO THE CITY OF REDDING ON PARCEL MAP 7-99 OVER PORTIONS OF PARCELS 1 THROUGH 7 OF PARCEL MAP 7-99 RECORDED IN BOOK 33 OF PARCEL MAPS AT PAGE 67, SHASTA COUNTY RECORDS, AS MORE PARTICULARLY DESCRIBED HEREIN (A-10-03). WHEREAS: A. 10' Sewer Easement, Temporary Road & Utility Easement, and a Building Exclusion Zone were dedicated to the City of Redding on Parcel Map 7-99 (collectively, "Easements"). B. The owners of the ]property have asked that the City vacate the easements described as follows: 10' Sanitary Sewer Easement "B" as shown on Parcel Map 7-99, see Exhibit A attached and made a part hereof by reference, as it has been superceded by relocation. Temporary Road and Utility Easement "C' as shown on Parcel Map 7-99, see Exhibit A attached and made a part hereof by reference, as it has been superceded by relocation. Easement "D", Building iExclusion Zone as shown on Parcel Map 7-99, see Exhibit A attached and made a part hereof by reference, as it has been superceded by relocation. C. The Engineering Division of the Development Services Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the proposed vacations. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. The City Council approves the request to summarily vacate the 10' Sanitary Sewer Easement "B", Temporary Road & Utility Easement "C", Easement "D" Building Exclusion Zone that were dedicated to the city of Redding on Parcel Map 7-99, see attached Exhibit A (collectively, "Easements"), as more particularly described in Paragraph B of this resolution. The "easements" have all been superceded by relocation. Therefore, from and at~er the date this resolution is recorded, the "easements" shall be vacated in their entirety and no longer constitute easements for public purposes. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
