HomeMy WebLinkAboutReso 2004-005 - Redding Impact FeesRESOLUTION NO. 2004- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING MAKING FINDINGS CONCERNING UNEXPENDED FUNDS IN THE CITY OF REDDING'S IMPACT FEE PROGRAM. WHEREAS: Al The City of Redding has had a range of impact fees in effect for several years. The Traffic Impact Fee and the Water and Sewer Impact Fees are the most notable. In April 2001, the City Council of the City of Redding adopted a major revision t0 the Impact Fee Program for the City of Redding. B. California Government Code §66000, et seq. defines specific reporting requirements to provide for a public accounting of revenues and expenditures in the Impact Fee Program. The reporting must be available to 'the public within 180 days of the end of the fiscal year, and the City Council must review the information not earlier than 15 days of availability to the public. In the fifth year after funds are first deposited, and annually thereafter, the City must make certain findings concerning the status of those monies. C. To satisfy these requirements, staff has prepared a Mitigation Fee Act Report Update--Annual Findings,-for the fiscal year ended June 30, 2003 (the Report). A public notice of the availability of the Report was published in the Record Searchlight newspaper on December 12, 2003. D. The City Council has accepted the Report on today's date, prior to the adoption of this resolution. E. All legal prerequisites to the adoption of this resolution have occurred. THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES AND ORDERS AS FOLLOWS: 1. The matters set forth above are true and correct. Pursuant to California Government Code §66001, the City Council makes the following findings concerning all the impact fee accounts with unexpended funds, which, for the Mitigation Fee Act Report Update--Annual Findings--for the fiscal year ended June 30, 2003, means all the accounts for all development impact fees: (a) The Report identifies the purpose to which each development fee is to be put. That information is set forth in the Comprehensive Impact Fee Study (Section C) and the Capital Improvement Plan (Section E). (b) The Report demonstrates a reasonable relationship between each fee and the purpose for which it is charged. That information is set forth in the Comprehensive Impact Fee Study (Section C), the Impact Fee Ordinance 2283/Agenda Items/Minutes (Section D), and the Capital Improvement Plan (Section E). (c) The Report identifies all sources and amounts of funding anticipated to complete financing of incomplete improvements for the listed projects. That information is provided in the City Manager's August 3, 2000, Addendum to the Comprehensive Impact Fee Study (contained in Section D) and the Capital Improvement Plan (Section E). (d) The Report identifies the approximate dates on which the supplemental funding noted above in section (c) will be deposited in the appropriate account. That information is set forth in the Capital Improvement Plan (Sections E and E-l).
