The portion being considered for summary vacation was acquired by Shasta County from the State of California in 1955 and passed to the City through annexation in 1968. B. The street right-of-way has not been used for the purpose for which it was dedicated or acquired. Therefore, the owner of the parcels located at 935, 943, and 995 Twin View Boulevard has asked that the City vacate a portion of the street fight-of-way, as more particularly described in Exhibit A, and shown crosshatched on Exhibit B attached hereto and made part hereof by reference. C. The Engineering Division of the Development Services Department has advised the City Council that there are in-place public utility facilities that are in use or that would be affected by the proposed vacation, therefore, the City is retaining public service rights. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: The City Council elects to proceed in this matter under the provisions of thc Public Street, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. The City Council approves the request to summarily vacate the street right-of-way, as more particularly described in Paragraph B of this resolution.. o The street right-of-way has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding this vacation. The City reserves and excepts from the vacation a public service easement for the purpose of erecting, installing, constructing, removing, repairing, replacing, reconstructing, maintaining and using for public service purposes any and all materials, fixtures, and equipment necessary for the transmission, distribution, and delivery of electricity, water, sewer, storm water, gas, cable television, communications and information service utilities over, along, upon, under and across the area described in Exhibit A and shown crosshatched on Exhibit B attached hereto. The City Clerk is directed to cause this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
