A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING ADOPTING DETAILED FINDINGS TO SUPPORT
THE MAY 20, 2008, CITY COUNCIL DECISION TO APPROVE
USE PERMIT AMENDMENT UP-S7-93 FOR THE LIVING HOPE
MINISTRY EXPANSION
WHEREAS, on April 22, 2008, the Redding Planning Commission conducted a public hearing and
at the close of said hearing found the necessary findings for approval to be in evidence and approved
Use Permit Amendment UP-57-93 (Living Hope Ministry Expansion); and
WHEREAS, in accordance with Chapter 18.11 of the Redding Municipal Code, the Parkview
Neighborhood Association (PNA) filed an appeal to the City Council of the Planning Commission's
decision to approve Use Permit Amendment UP-57-93; and
WHEREAS, on May 20, 2008, after conducting a public hearing and considering the letter of appeal,
Planning Commission hearing record, and staff report and after considering all testimonial and written
evidence submitted prior to and during the public hearing, the City Council voted to deny the PNA
appeal and uphold the Planning Commission's approval of Use Permit Amendment UP-57-93, with
the exception of a revision to Condition 3, as proposed by staff and included hereto in Attachment "A";
NOW, THEREFORE, IT IS RESOLVED by the City Council of the City of Redding that the
findings of fact attached as Attachment "8" are appropriate and proper to support approval of Use
Permit Amendment UP-57-93 for the reasons as set forth in the findings of fact.
BE IT FURTHER RESOLVED that the City Council of the City of Redding hereby approves the
Amendment to Use Permit UP-57-93, subject to the attached conditions of approval (Attachment "A").
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted at a regular

Use Permit UP-57-93 Amendment
Conditions of Approval
General Requirements
1. Approval is granted for a 1,920-square-foot building expansion and comprehensive interior and
exterior building remodel of an existing daytime community social-service drop-in center, to
be constructed in substantial conformance with the site and elevation plans approved by the
Planning Commission on April 22, 2008. Minor modifications may be approved by the
Development Services Department; any substantial revisions will require either an amendment
to this permit or a new use permit.
2. The permitted use/improvements shall comply with the Use Permit/Site Development Permit
Standard Conditions of Approval established under Planning Commission Policy PC-I-99
effective May 2, 2000, for those conditions that are checked as applicable to the project (see
attached).

3. Conditions 4. 6. 7. and 9 through 18 shall become effective 30 davs after aonroval of the use
oermit amendment and be aoolicable to the existing church/social services facilitv. All other
conditions shall be satisfied orior to issuance of an OCCUDancv Dermit for the allowed building
exoansion.
4. Functions and their respective hours of operation allowed at the facility generally include the
following:
a Chapel services-8 a.m. to 8 p.m.
b. Daytime meals-8 a.m. to 5 p.m.
c. Laundry facilities-8 a.m. to 5 p.m.
d. Shower facilities-8 a.m. to 5 p.m.
e. Clothing distribution-8 am. to 5 p.m.
f. Counseling and training services-8 a.m. to 8 p.m.
g. Emergency food and grocery distribution-8 a.m. to 5 p.m.
h. Health services-8 a.m. to 5 p.m.
i. Administrative offices-Unlimited.

5. Final development plans shall be approved by the Planning Division prior to issuance of a
building permit. Said plans shall consist of a final site plan, floor plan, landscape and
irrigation plan, signage plan, buffer-yard-wall design, and detailed architectural elevations.
6. Parking is based upon the specific demand for the community social-service facility. Parking
is to be improved in accordance with Chapter 18.62 of the Redding Municipal Code with a
minimum of 7 spaces, including I handicap-parking space, and facilities for a minimum of
15 bicycles. The bicycle parking shall be located at the south end of the parking lot; all
bicycles shall be stored in the designated area (e.g., no bicycle parking on the sidewalk).
7. Future uses of the building will be limited by the number of off-street parking spaces available
at the site. A conversion to a more intensive use will require that the new use meet all City
on-site Parking Code requirements in effect at the time of the conversion.
8. Roof-mounted mechanical equipment shall not be visible from the street or adjacent properties.
Screening of such equipment shall be accomplished by the parapet walls of the building, roof
wells, or screen walls architecturally compatible with the building.
9. Any night lighting is to be oriented so as to not glare onto adjacent residential areas or public
right-of-ways. A lighting plan shall be submitted to the Planning Division for review and
approval prior to issuance of a building permit.
Performance
10. The capacity ofthe dining room shall be limited to 90 seats. Dining service may be provided
on a continuous basis or in shifts.

12. There shall be no overnight activities at the site, including overnight lodging or sleeping
accommodations.
13. The applicant shall monitor client loitering within the parking area and shall establish a
designated smoking area at the south end of the parking lot. The final location of this area is
to be approved as part of the final plan review approval (Condition 5). Staff shall be provided
to monitor the parking lot, smoking area, and other outside areas within 1 block in all
directions of the site during business hours with the purpose ofpreveriting excessive loudness,
littering, and loitering by clients of the facility.
14. Provision of services shall occur within the building or, if a mobile unit is utilized to provide
a service, the unit shall be located on the west (Favretto Street) side of the building with no
more than 5 users assembled on the street; all others waiting for service shall wait within the
building.
15. The applicant shall develop a procedure to monitor client clothing and bedding distribution.

16. Trash and debris along State Street between Favretlo A venue and Akard Avenue and at the
project site shall be picked up prior to the close of business each day.
17. Security lighting shall be provided within the parking area and alleyway.
18. All outdoor storage is prohibited.
Streets, Circulation, Utilities, Sewer, Water, Fire, Grading, and Drainage
19. The developer shall secure approval of civil engineering improvement plans from the Land
. Development Division and Redding Electric Utility for all street, streetlight, sewer, water,
dminage, electric, and other public-utility improvements associated with the project.
20. The existing driveway encroachment to Favretto Street shall be removed and replaced with
curb, gutter, and sidewalk as required by the City Engineer.
21. The following applications to the Municipal Utilities Department, Industrial Waste Division,
shall be submitted at the time of submittal of a building permit application:
a. An Industrial Wastewater Survey/Application #1 shall be completed for this project for
a determination of applicable wastewater pretreatment requirements.
b. An Industrial Wastewater Survey #2 for the evaluation and sizing for wastewater
pretreatment of oil- and grease-removal requirements for the proposed food facility.
22. An oil and grease interceptor shall be installed for the food-preparation facility.
23. The trash enclosure shall be angled to allow for access by Solid Waste Division trucks from
the alley in accordance with the requirements of the Solid Waste Division.
Landscape and Fencing
24. Irrigated landscape planters shall be installed in substantial compliance with the approved site
plan, incorporating the following:
a A 15-foot-wide landscaped planter adjacent to State Street. Any area between the back
of the sidewalk and the property line shall be incorporated into the adjacent street-side
planter. The fence adjacent to State Street shall be set back a minimum of 5 feet from
the property line. The street-side landscape shall be designed to be security oriented.
b. Four City-approved street trees, placed in evenly spaced tree wells located within the
sidewalk adjacent to Favretto Street. Irrigation shall be supplied to each tree well. The
final design and location of the tree wells shall be reviewed and approved by the
. Planning Division and City Engineer. Trees shall be a minimum of 15 gallons in size.
c. The existing planters adjacent to the east and north walls of the building shall be
refurbished.

d. A minimum 6-foot-wide planter shall be constructed along the east property line,
incorporating IS-gallon trees on 20-foot centers and including large shrubbery.
e. Planters shall be protected from vehicles by 4-inch-high extruded asphalt concrete curbs
.or equivalent materials.
f. Planters not utilizing densely planted ground cover or turf shall include the use of high-
quality-fabric weed barrier and appropriate mulch materials.
g. All parking-lot and landscape improvements shall be completed prior to issuance of an
occupancy permit.
h. A landscape plan is to be approved by the Development Services Department prior to
issuance of a building permit.
25. The existing barbed wire located on the fencing adjacentto Favretto Street and in the alleyway
within 25 feet of Favretto Street shall be removed.
26. a. An 8-foot-tall masonry wall shall be constructed along the east property line.
Modifications to wall material or design in order to preserve established trees and
substantial vegetation may be approved during final plan review.
b. A 6-foot-high chain-link fence shall be constructed at the south end of the property
between the east property line and the southeast comer of the building.
Signs
27. The applicant shall submit plans for signage to the Planning Division for review and approval
prior to installation of any signs.
Environmental Health Department Review
28. Plans and specifications for the kitchen shall be submitted to the Shasta County Division of
Envirorunental Health for review and written approval prior to issuance of a building permit.

General Requirements
si1.
In accordance with Chapter 18.11.100 of the Zoning Ordinance, the entitlement authorized
by approval of this permit shall automatically expire 3 years from the date of approval,
without further notice or action by the City, unless anyone of the following occurs:
a. A building permit has been issued and substantial construction has occurred upon
reliance of the entitlement as determined by the Development Services Director.
b. The use of the property specifically authorized by the entitlement has been established
or commenced as determined by the Development Services Director.
c. Approval of the entitlement has been extended for I year by the Development Services
Director.

The requirements of the California Building Code and the California Fire Code are to be met.
The project proponent is responsible for contacting the offices of the Building Division and
Fire Department to verifY compliance or the need to obtain permits.
Site Development
.!Zl 3. In accordance with Title 24, Part 2, of the California Building Code, at least I accessible
route within the boundary of the site shall be provided from public transportation stops,
accessible parking and accessible loading zones, and public streets and sidewalks to the
accessible building entrance served. The accessible route shall be a minimum of 4 feet in
width; shall not pass behind a designated parking space; shall not exceed a slope of5 percent
-or Ii cross slope of2 percent; and shall, to the maximum extent feasible, coincide willi the
route for the general public.
.J2I 4. Trash and recycling enc1osure(s) shall be provided as depicted on the approved site plan.
The enclosure shall be located and constructed in accordance with Section 18.40.120 of the
Redding Municipal Code.
J/J 5. All existing landscaped areas or new areas required by use permit andlor the approved
landscape plans shall be properly and continuously maintained during the life of the use or
activity authorized by the permit. Maintenance shall include providing an operational,
automatic irrigation system; weeding; replacing dead and missing plant materials; mowing
lawns; pruning; and other maintenance applications as required to keep all planted areas neat,
healthy, and attractive.

~ 6. Signage shall be in compliance with Chapter 18.42 of the Redding Municipal Code.
Sewer, Water, and Drainage Utilities

Sewer lines, waterlines, electric-service facilities, and other utilities; drainage facilities;
necessary electric- and public-service easements; and street dedications are to be provided
in accordance with the Redding Municipal Code and as specified by the Engineering
Division.
The developer shall extend sewer and water lines and electric substructures and conduits as
necessary to serve the property and provide logical extensions of service through the property
boundaries to adjacent properties.
New utilities within the project, including, but not limited to, electric, cabie television, and
phone, shan be installed underground.

The developer shall be responsible for all costs associated with the relocation or modification
of existing utility facilities or structures necessitated by the construction of the project or of
improvements required as a condition of approval of this project, including reimbursement
of any costs to City of Redding Electric Utility for work performed.
The developer shall consult with the Electric Department after the initial review by the
Engineering Division of the improvement plans for preparation of an electric-service plan.
A copy of the electric-service plan, developed by the Electric Department, shall be
incorporated into the final improvement plans.
Electric-supply facilities shall be furnished and installed in accordance with the Electric
Utility Service Policy Resolution currently in effect at the time the electric-service plan for
the project is signed by the City Electric Department.
Effective January I, 2008, a separate water meter and water service shall be provided for
irrigation oflandscape areas when a project includes more than 5,000 square feet ofirrigated
landscape. An utility and landscape plans submitted for projects that win commence
coDSUuction on, or after, January I, 2008, shall depict the proposed location of the water
meter and identify the total area oflandscape proposed with the project.
Fire Protection
014. On-site and street-side fire hydrants are to be installed in accordance with the California
Fire Code in locations approved by the City Fire Marshal. Fire hydrants shall have a fire

flow meeting Appendix III-A of the California Fire Code. In no case shall the water
mains be less than 6 inches in diameter. If a hydrant is located on private property,
adequate access shall be provided to and around the hydrant as determined by the Fire
Marshal.

The developer/applicant shall note that pursuant to Chapter 16.45 of the Redding Municipal
Code, a Citywide Tmffic Impact Fee is required to be paid at the time of issuance of a
building permit for new construction, building enlargement, or other improvement which
will genemte additional tmffic. All other development fees required by City Ordinances or
Resolution shall also be paid at the time of issuance of a building permit or prior to final
inspection by the Building Division.
Ground-mounted mechanical equipment with a total cooling capacityof5 tons or greater and
within 30 feet of any residential district shall be bordered by a solid block noise wall not less
than 1 foot higher than the top of the cooling equipment. Construction and location of the
wall must conform to currently adopted construction codes.
All exterior freestanding or building-mounted lighting is to be oriented or shielded in a
manner to prevent light from being cast onto adjacent residences, residentially zoned
property, or public rights-of-way. The point source ofilIumination shall not be visible from
any residence or residentially zoned property. A lighting detail demonstmting how these
requirements will be satisfied shall be submitted to and be approved by the Development
Services Department prior to issuance of a building permit.
Freestanding parking lot light standards shall be located within a landscape planter or other
protected area so as to eliminate the need for a mised concrete pedestal. The light-standard
base shall not exceed 6 inches in height above the finished grade of the landscape planter.
If the base must be higher than 6 inches to afford adequate protection to the standard, the
Concrete base shall have a decomtive finish (e.g., textured, exposed aggregate, sandblasted).
The project design shall include storm-drain detention to detain the increased storm dminage
due to the development of the property based on 10-, 25-, and lOO-year-storm frequencies
at 6-hour dumtions. A gmding permit shall be obtained from the Engineering Division with
each phase of construction and shall include plans and information necessary to demonstrate
Compliance with this requirement.
o 6. The developer shall install streetlights on all public-street frontages as required by the
Engineering Division in accordance with the City Construction Standards.
III 7. A minimum 5-foot-wide public-utility easement is to be provided adjacent to all public-road
rights-of-way.

o 8. Fire-protection facilities, including all-weather access roads, shall be installed and remain
serviceable prior to and during the time of construction.
o 9. All brush piles created by site improvement shall be abated or removed prior to the next fire
season.

ATTACHMENT "B"
FINDINGS
In accordance with Chapter 18.14.070 of the Redding Municipal Code, the following findings are
made to support approval of Use Permit Amendment Application UP-58-93.
USE PERMIT FINDINGS
Section 18.14.070 of the Redding Municipal Code stipulates that the Planning Commission shall
approve an application for a use permit as it was applied for or in modified form if, on the basis of
the application, plans, materials, and testimony submitted, the Planning Commission finds:
I. That the proposed use will not be detrimental to the health, safety, and general welfare of
persons residing or working in the neighborhood of such proposed use.
a. The project site is properly zoned for a community social service facility.
b. Living Hope Compassion Ministries (Living Hope) serves a segment of the surrounding
neighborhood population.
c. The proposed project is not a significant expansion; rather, it will result in an improvement
to the existing service delivery that will result in a more efficient and dignified manner..
d. Conditions of approval have been applied to the project approval which will minimize
potential project impacts related to noise, lighting, littering, and loitering.
e. The project will result in improvements to the site and the exterior of the building that will
enhance the appearance of the building, resulting in benefits to the general welfare of
persons residing or working in the surrounding neighborhood.
2. That the proposed use will not be ilyurious or detrimental to the general welfare of the city.
a. Living Hope provides services to an under served segment of the City population in need
of basic living support.
b. The use will reduce demands on government -supported social service agencies and law
enforcement.
3. That the proposed use is consistent with the policies and goals established by the General Plan
and this code.
a. The project site possesses the appropriate General Plan and Zoning designation for the use.
b. The project supports the following goals and policies established by the General Plan:
l. Housing Element
(I) Goal H4 Enhance the quality of life within residential neighborhoods.

groups within the community.

Develop and maintain effective linkages with community service

11. Parkview Neighborhood Strategic Revitalization Plan
Land Use and Urban Design
Goal:
To improve the attractiveness of the entrances into the
neighborhood in order to make them more aesthetically pleasing
and improve property values, both at the entrance and inside the
neighborhood.
Social Services
Goal:
Provide a coordinated and accessible delivery of services to
community members through the creation of a Multi-Service
Center, where families and individuals find support and
opportunities to ensure their basic needs are met and to foster
increased community involvement that leads to a greater sense
of community.
c. The use as conditioned, is consistent with the development standards of the Zoning
Ordinance. The Zoning Ordinance recognizes Community Social Service Facility as a
specific use and allows for such uses within the "HC" Heavy Commercial District, which
is the applicable zoning of the project site. Furthermore, Community Social Service
Facility is a semi-public use as identified in the "PF" Public Facilities District. In
recognition of the unique nature of semi-public uses, the Zoning Ordinance allows
flexibility in satisfying development standards through conditions of approval in a use
permit.
4. The proposed use and project design are consistent with the design guidelines established by
resolution of the City Council in accordance with Section 18.40.050, Design Criteria.
a. The building renovation plans satisfies the City's Design Criteria for a building in the "HC"
Heavy Commercial zoning district.
