Code §6103 A.P.N. 070-18-24 1111111111111111111111111111111111- Reco~ed Official Records CRIS P)IDREHS Recorde~. ~8:5c!~ 17-0ct-~3 REC FEE . ~ drs Page I of 7 RESOLUTION NO. 2001-__~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING A PORTION OF THE BECHELL1 LANE (AKA SUNNYHILL LANE) STREET RIGHT-OF-WAY GENERALLY LOCATED ADJACENT TO 5050 AND 5015 BECHELLI LANE AND INTERSTATE 5 IA-I-01]. WHEREAS: A. Through annexation, from the County of Shasta, the City of Redding acquired all rights in fee to the property located between Interstate 5, 5015 and 5050 Bechelli Lane for public use. The County received the land from Caltrans as excess right-of-way which it had purchased in fee. B. The Hilton Garden Inn Hotel project (the "Project") located on property located at 5050 Bechelli Lane, initiated by the Redding Rancheria Economic Development Corporation (RREDCO), will require the realignment of approximately 750 feet of Bechelli Lane adjacent to the Project site. C. On this date the City Council authorized property-line adjustment PLA-I-01 between RREDCO and the City of Redding. D. With the proposed realignment bf Bechelli Lane, a portion of the land owned by the City will no longer be required :for street purposes. E. it is the recommendation of staff that the City summarily vacate the street area adjacent to Interstate 5,5015 and 5050 Bechelli Lane, as more particularly described in Exhibit A and shown crosshatched on Exhibit B (consisting of three pages) attached and made a part hereof by reference, subject to the conditions set forth in paragraph 3 of this resolution. NOW, THEREFORE, THE CITY COUNCIL FINDS, DETERMINES, REsOLvES AND ORDERS AS FOLLOWS: o When the conditions set forth in paragraph 3 of this resolution have been met, the area proposed for vacation will have been superseded by the realignment (relocation) of Bechelli Lane. The City Council elects to proceed in this matter under the provisions of the: Public Streets, Highways and Service Easements Vacation Law as set forth in §§ 8333, et seq., of the Streets and Highways Code of the State of California. Pursuant to Streets and Highways Code § 8333, the City Council approves the request to summarily vacate the area adjacent to Interstate 5, 5015 and 5050 Bechelli Lane, as more particularly described in Exhibit A and shown crosshatched on Exhibit B (consisting of three pages) attached and made a hereof by reference, subject to the fi}llowing conditions: (a) That the land required for the realignment (relocation) of Bechelli Lane as depicted in Exhibit C attached and made a part hereof by reference has been deeded to the City in fee; (b) That property-line adjustment PLA-l-01 providing for the new alignment of Bechelli Lane has been recorded; (c) That the new Bechelli Lane street improvements have been constructed and accepted by the City; and (d) That the City reserves and excepts from the vacation a public service easement for the purpose of erecting, installing, constructing, removing, repairing, replacing, reconstructing, maintaining, and using for public service purposes any and all materials, fixtures, and equipment necessary for the transmission, distribution, and delivery of electricity, water, sewer, storm water, gas, cable television, communications and information service utilities over, along, upon, under and across the area described in Exhibit A and shown crosshatched on Exhibit B (consisting of three pages) attached hereto. When the conditions set forth in paragraph 3 above have been met and/or the documentation is ready to record concurrently, the City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder---either directly or, if advised by the City Attorney, through escrow. From and after the date this resolution is recorded, the area hereby vacated shall no longer be used for street purposes.
