LANDSCAPE MAINTENANCE DISTRICT B
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDDING:
(1) CONFIRMING THE MAPS OF THE ASSESSMENT
DISTRICT CONTAINED IN THE ENGINEER'S REPORT;
AND
(2) ORDERING THE LEVY OF THE ANNUAL ASSESSMENTS
FOR FISCAL YEAR 2003-2004 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972
(COMMENCING WITH SECTION 22500 OF THE
STREETS AND HIGHWAYS CODE).
WHEREAS:
A. On May 20, 2003, by Resolution 2003-76, the City Council approved the Report of
the Engineer as filed relating to Landscape Maintenance District B (District), and gave notice of the
time and place of the June 3, 2003, public hearing regarding the levy and collection of assessments
for fiscal year 2003-2004. On June 3, 2003, the public hearing was continued until June 17, 2003,
so that the matter of the annexation of the Tierra Bendito Subdivision could also be considered on
June 17, 2003.
B. A map of the area encompassed by the District, individual maps, and a summary are
attached and made a part hereof..
C. The public hearing, duly and properly noticed, commenced at the City Council
Chambers, 777 Cypress Avenue, Redding, California, on June 17, 2003, and was concluded prior
to the adoption of this resolution. At the public hearing, the City Council gave every interested
person an opportunity to object 'to the proposed assessments.
D. All legal prerequisites to the adoption of this resolution have occurred.
THEREFORE, THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND
ORDERS AS FOLLOWS:
1. The matters set forth above are true and correct.
2. The maps of the assessrnent district contained in the Engineer's Report are confirmed.
The City Council has considered all oral statements and written protests or communications
made or filed by interested persons at the public hearing of June 17, 2003, and expressly
overrules any and all protests field objecting to the proposed assessments to be levied in the
District.
The City council finds that the Engineer's Report has fairly and properly apportioned the
costs of the improvements to each lot/remaining parcel of land in the district in proportion
to the estimated benefits to be received by each lot/remaining parcel of land fi'om the
improvements.
An assessment of $71.00 against each lot/remaining parcel located within the District for
fiscal year 2003-2004 is adopted and confirmed, except that an assessment shall not be levied
on property owned by a federal or state governmental agency or another local agency.
The City Clerk shall forthwith transfer to the Auditor-Controller and the Assessor-Recorder
of Shasta County a certified copy of this resolution and a certified copy of the assessment
district maps contained in the Engineer's Report for Landscape Maintenance District B.
