LANDSCAPE MAINTENANCE DISTRICT "B"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
DECLARING ITS INTENTION TO:
(1) ANNEX THE TIERR3. BENDITO SUBDIVISION INTO AREA 3 OF THE
DISTRICT; AND
'(2) LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2003-2004
PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972,
COMMENCING WITH SECTION 22500 OF THE STREETS AND
HIGHWAYS CODE.
WHEREAS:
A. The City Council. heretofore ordered the consolidated formation of Landscape
Maintenance District "B" (District) under authority granted by the Landscaping and Lighting Act of
1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of
California.
B. The purpose of the District is to provide maintenance to those landscaping
improvements required within the public rights-of-way by the conditions of development approval
of the subdivisions contained therein.
C. Minor improvements are proposed for fiscal year 2003-2004.
D. The Engineer has filed his Report with the City Clerk pursuant to Streets and
Highways Code Section 22565, et seq., and the City Council approved the Report for' District "B"
on May 20, 2003.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL THAT:
1. It is the intention of the City Council to:
(a)
Annex Lots 077-560-01 through 077-560-27 inclusive, of the Tierra Bendito
Subdivision into Area 3 of the District The developer has signed a Petition and
Consent for the annexation, and a waiver of the proceedings pursuant to Streets and
Highways Code Section 22608, and has filed the Petition and Consent and waiver of
the proceedings with the City Clerk; and ,
(b)
Levy and collect assessments for fiscal year 2003-2004 equally amongst all the lots
and remaining parcels that encompass the District, which lots and remaining; parcels
are more particularly described in the location maps, on file with the City Clerk, and
made a part hereof, except that it shall not impose an assessment upon a federal or
state governmental agency or another local agency..
The Report of the Engineer, on file with the City Clerk, contains a full and detailed
description of the improve:ments, the boundaries of the District-including the areas proposed
to be annexed in-and any zones therein, and the proposed assessments upon the assessable
lots and remaining parcels within the District.
The existing improvements for each subdivision in the District are set forth in Part G of the
Engineer's report, incorporated herein by reference and on file with the City Clerk, under the
column entitled "Landscape Description."
The general locations of the lots and remaining parcels in the District are set forth inPart G
of the Engineer's Report, on file with the City Clerk, under the column entitled
"Access/Location."
Minor improvements are proposed for fiscal year 2003-2004. Only costs for the maintenance
of landscaping, miscellaneous lighting, mulching, vandalism, repairs to the irrigation system,
electric and water charges, replacement of vegetation as necessary, removal of trimmings,
rubbish, debris, maintenance of the detention basin, and other improvements to remove or
cover gr~ffiti, administrative costs, painting of any walls, and such other maintenance and
incidental expenses as are authorized by Streets and Highways Code Sections 22526 and
22531, will be assessed.
A public hearing will be held on Tuesday, June 17, 2003, at the hour of 7:00 p.m., or as soon
thereafter as the matter rnay be heard, in the City Council Chambers located at 777 Cypress
Avenue, Redding, California, to address the proposed annexation of the additional te~xitories
to the District and the levy of the proposed assessment for fiscal year 2003-2004. The
proposed assessment for fiscal year 2003-2004 of $71.00 is the same as last year's
assessment.
I HEREBY CERTIFY that the foregoing resolution of intention was introduced, read and adopted
at a regular meeting of the City Council on the 3rd day of June, 2003, by the following vote:
