ORDINANCE NO. 2398
. AN ORDINANCE AMENDING TITLE 16 (BUILDINGS AND
CONSTRUCTION), CHAPTER 16.20 (DEVELOPMENT IMPACT FEES),
OF THE CITY OF REDDING MUNICIPAL CODE BY AMENDING
SECTION 16.20.040 AND ADDING SECTION 16.20.072, REGARDING
THE ADOPTION OF A NORTH REDDING TRAFFIC IMPACT FEE
ZONE
WHEREAS, pursuant to Chapter 16.20 of the Redding Municipal Code, the City Council of
the City of Redding may establish development impact fees to assist in the implementation of the
City of Redding General Plan and to mitigate the impact of development identified in the documents
titled "Comprehensive Impact Fee Study for the City of Redding," dated May 19, 2000, and the final
Environmental Impact Report for the City of Redding General Plan; and
WHEREAS, MuniFinancial has prepared the North Redding Traffic Benefit District Traffic
Impact Fee Study, dated August 27,2007 ("Report"), which is incorporated herein by reference, to
provide the legal and policy justification for a traffic impact fee in the North Redding Traffic Benefit
District to fund a portion of the costs associated with the reconstruction of the interchange and the
widening and realigning of Oasis Road, Cascade Boulevard, and Twin View Boulevard, and other
associated projects referenced in the Report; and
WHEREAS, the development of the parcels in the North Redding Traffic Benefit District will
increase vehicle trips to the intersection of Interstate 5 and Oasis Road and necessitate the
reconstruction and expansion of the interchange and the realignment and widening of Oasis Road,
Cascade Boulevard, and Twin View Boulevard, and other associated projects referenced in the
Report to accommodate the increased trip demand; and
WHEREAS, the Report provides the justification to allocate a portion of the project costs to
the parcels within the zone based on their relative shares of trips generated within the zone; and
WHEREAS, the Report provides justification to allocate a portion of the project costs to
parcels outside the zone based on the relative share of trips generated from other areas that will
utilize the proposed improvements; and
WHEREAS, the Construction Cost Index published by the Engineering New Record is deemed
a reputable and reliable source of information on the inflation of construction costs and may be used
periodically as a basis for fee inflation through separate City Council action;
NOW, THEREFORE, IN ORDER TO CREATE THE NORTH REDDING TRAFFIC
IMPACT FEE ZONE AND ESTABLISH IMPACT FEES TO BE IMPOSED WITHIN THAT
ZONE AND OUTSIDE THAT ZONE, THE CITY COUNCIL OF THE CITY OF REDDING
DOES ORDAIN AS FOLLOWS:
Section 1. Title 16, Chapter 16.20, Section 16.20.40, subsection 16.20.40C is hereby
amended as follows:

C. Fee schedule. The following fee schedule is based on an analysis of proportional impact ofthe
various types of new building construction on the City's transportation system as outlined in the
Comprehensive Impact Fee Study dated May 19, 2000, as amended on January 22, 2004, and
the North Redding Traffic Benefit District Traffic Impact Fee Study, dated August 27, 2007.
The fee imposed pursuant to this section shall be based on the fee schedule in effect on the date
of the feepayer's application for the appropriate building permit and shall be paid to the City
prior to the issuance of a building permit or a permit for mobile home installation, as follows:
I. Single Family.
I. The basefee shall be $5,159.34.
2. Each July I the base fee shall be increased by the Construction Cost Index as
published in the most recent May Engineering News Record.
2. Multiple Family-base fee is per dwelling unit.
I. The base fee shall be $3,508.59.

3. Commercial-base fee is per 1,000 square feet. The base fee applies to General
Commercial only. For High-Generation Commercial, the base fee is doubled; for Low-
Generation Commercial the base is halved.
I. The base fee shall be $12,372.22. Thefee collected shall be 89.875% of the base fee.
Effective 7/1/08 the fee collected shall be 100% of the base fee.
2. Each July I the base fee shall be increased by the Construction Cost Index as
published in the most recent May Engineering News Record.
4. Office/general-base fee is per 1,000 square feet.
1. The base fee shall be $9,622.64. The fee collected shall be 89.625% of the base fee.
Effective 7/I/08 the fee collected shall be 100% of the base fee.
2. Each July I the base fee shall be increased by the Construction Cost Index as
published in the most recent May Engineering News Record.
5. Industrial-base fee is per 1,000 square feet.
I. The base fee shall be $4,949.49. The fee collected shall be 89.625% of the base fee.
Effective 7/1/08 the fee collected shall be 100% of the base fee.

published in the most recent May Engineering News Record.
Section 2. Title 16, Chapter 16.20, is hereby amended by adding Section 16.20.072 as
follows:
Section 16.20.072, North Redding Traffic Benefit District Impact Fee Zone
A. Purpose. The purpose of this fee is to provide for the costs of the reconstruction and expansion
of the interchange at Interstate 5 and Oasis Road and the realignment and widening of Oasis
Road, Cascade Boulevard, and Twin View Boulevard and other associated projects as
referenced in the Report within the North Redding Traffic Benefit District traffic impact fee
zone in accordance with the development forecast under the City of Redding General Plan. As
the amount of new development contemplated by the General Plan occurs, there will be an
additional burden on the district's surface transportation system in the North Redding Traffic
Benefit District impact fee zone. Without funding identified capital improvements, there will

be an unacceptable level of traffic congestion, delays, accidents, and generally reduced public
safety. Air quality could be adversely affected, as has been demonstrated in other studies, when
idle/standing times are increased.
B. Transportation Impact Fee Zone. There is established the North Redding Traffic Benefit
District fee zone with boundaries and affected parcels as shown and identified in Exhibit A,
attached and incorporated into this chapter by this reference.
C. Definition. For purposes of this section:
I. "Study" initially means the North Redding Traffic Benefit District Traffic Impact Fee
Study, dated August 29, 2007, and the project list and cost estimates contained therein. In
future years, as updated or replacement impact fee studies are completed, it shall mean
those updated or replacement impact fees studies.
D. Fee Schedule. The fee imposed pursuant to this section shall be based on the fee schedule in
effect on the date of the fee payer's application for the appropriate building permit and shall be
paid to the City prior to the issuance of a building permit or a permit for mobile home
installation as follows:
I. Single Family: the base fee shall be $4,058.00 per dwelling unit.
2. Multiple Family: the base fee shall be $2,759.00 per dwelling unit.
3. Office/General: the base fee shall be $7,102.00 per 1,000 square feet.
4. High-Generation Commercial: the base fee shall be $18,263.00 per 1,000 square feet
5. General Commercial: the base fee shall be $9,131.00 per 1,000 square feet
6. Low-Generation Commercial: the base fee shall be $4,565.00 per 1,000 square feet
7. Industrial: the base fee shall be $3,652.00 per 1,000 square feet.
E. Exemptions and Credits. The exemptions and credits detailed in Section 16.20.040(D) are
included within this section by reference.
F. Construction Cost Increases. Effective July I, 2008, and on each July I thereafter, the fee
shall be increased by the Construction Cost Index as published in the most recent May
Engineering News Record.
Section 3. It is hereby found and determined that the North Redding Traffic Benefit District
Traffic Impact Fee Study, dated August 27, 2007 ("Report"), meets the following requirements:
(I) identifies the purpose of the fee; (2) identifies the use to which the fee is to be put; (3) determines
how there is a reasonable relationship between the fee's use and the type of development project on
which the fee is imposed; (4) determines how there is a reasonable relationship between the need for
the public facility and the type of development project on which the fee is imposed; and
(5) determines how there is a reasonable relationship between the amount of the fee and the cost of
the public facility or portion of the public facility attributable to the development on which the fee
is imposed.
Section 4. The Council hereby finds and determines that the enactment of this ordinance is
exempt from the California Environmental Quality Act (Public Resources Code section 21000 et
seq.) ("CEQA") pursuantto CEQA Guidelines Section 15378(b)( 4) (California Code of Regulations
Section I 5378(b)(4)) because it is a fiscal activity that does not involve any commitment to any
specific project that may result in a potentially significant impact on the environment. The City
Clerk is hereby authorized to file a Notice of Exemption with the County of Shasta pursuant to
CEQA Guidelines Section 15094.

Section 5. Pursuant to Government Code Section 66020( d)( 1), adoption of the North Redding
Traffic Benefit District and this ordinance constitutes written notice of a statement of the amount of
development impact fees which will be collected from new development as set forth in the North
Redding Traffic Benefit District Traffic Impact Fee Study, dated August 27, 2007 ("Report").
Landowners within the North Redding Traffic Benefit District, having been duly notified regarding
adoption of the North Redding Traffic Benefit District, are further put on notice that the 90-day
period in which to protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If any Landowner duly put on notice fails to file
a protest within this 90-day period, complying with all of the requirements of Section 66020, the
landowner may be legally barred from later challenging such exactions.
Section 6. This ordinance shall take effect on January 15, 2008. The City Clerk shall certify
to the adoption thereof and cause its publication according to law.
I HEREBY CERTIFY that the foregoing ordinance was introduced and read by the City
Council at a regular meeting on the 16th day of October, 2007, and was duly read and adopted at a
regular meeting on the 6th day of November, 2007, by the following vote:
