RESOLUTION NO. 2007 - 234 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING AMENDING THE SOLID WASTE UTILITY RATE SCHEDULE AND SERVICE POLICIES WHEREAS: A. On May 3, 1999, by Resolution 99-67, the City Council adopted a new Solid Waste Utility Rate Schedule and Service Policies effective July 1st of the years 1999 through 2003. B. Further changes, updates, and clarifications were made to the Rate Schedule by the Redding City Council on the following dates: Resolution Date Topic No. 1999-84 June 15, 1999 Added rates for large loads; scrap metals, and auctioned goods. 1999-133 October 5, 1999 Adjust rates for SIX yard containers and clarification on off-street collection. 2000-115 June 20, 2000 Electronic waste charges. 2001-122 July 17, 2001 Adjusted fee related to automation of green waste and recycling, contamination, duplicate receipts, rounding off, etc. 2002- 139 September 17, 2003 Clarify Section L to include a minimum charge for weighed loads of self-hauled waste and green waste equivalent to the lowest volume charge and to limit the per-bag or can charge to a maximum ofthree containers. 2003-123 August 5, 2003 Established policies and rates for Prohibited Items in Collection Containers and a Special Pick Up Program within the City. 2004-35 March 2, 2004 Fees for uncovered loads to the Transfer Station. 2004-61 April 20, 2004 Eliminate Benton Landfill surcharge and increase rates in the same amount to fund street sweeping by the Solid Waste Utility. 2006-31 February21,2006 Modify the Solid Waste Utility Rate Schedule to reflect increase in rates. ~ & ..( Resolution No. 2007-234- . The City Council desires to update the Solid Waste Utility Rate Schedule and Service Policy to more clearly reflect current policies, programs and service fees, including those policies and service fees reflected in contracts for drop boxes and containers. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby amends and adopts the Solid Waste Rate Schedule and Policies as set forth in Exhibit A, attached hereto. Minimum Property Charge. Within the City of Redding, all developed properties shall pay, at least, a minimum monthly solid waste collection fee. This fee shall be the same as the fee shown below for wheeled cart service provided by the City for one 64-gallon waste cart. B. Wheeled Waste Cart Service Fees for Waste Collection. (I) Regular Service: Monthly fees for the scheduled service of wheeled waste carts shall be as shown on the schedule below for each dwelling unit or household. For residential properties, the charge shall include curbside waste collection, curbside recyclables collection, curbside green waste collection, and curbside Christmas tree collection. For commercial properties, this fee covers only curbside waste collection and curbside recyclables collection and in some commercial areas that border residential areas, curbside green waste collection. All rates are based on a per-household rate. Additional wheeled waste carts as listed below are not intended to provide service to other dwelling units or households. (3) Customer Error or Additional Collection: If the customer does not have the cart out for collection, or the automated truck's access to the cart is blocked or impeded on the day of collection, the following fee will be imposed if the City is asked to make a return trip: a. First Collection - A warning that an additional fee for a return trip will be charged in the future. No fee for first' courtesy return' trip. b. Additional Collections, Same-Day. Additional Collections, Other than Same Day of Collection. An additional fee of 65% of the monthly fee will be charged, per cart, as follows: CART SIZE 64-gallon cart 96-gallon cart 07/01/06 $11.05 $11.70 07/01/07 $11.38 $12.03 07/01/08 $11.70 $12.35 (4) Special Collections: Customers who request special curbside collections oflarge, bulky items that will not fit in a waste cart will be charged a fee equal to the rate for disposal at the Transfer Station, plus additional labor and equipment costs. (5) Charge for Replacement ofCart(s): The Solid Waste Utility reserves the right to charge the customer for the replacement cost of lost, stolen, damaged or destroyed carts. C. Non Curbside Collection Surcharge. Properties where wheeled waste carts, recyclables or green waste are not collected at the curb shall be charged an additional amount per month as follows: DATE RATE/MONTH RATE/WEEK 07/01/06 $3.40 $0.79 07/01/07 $3.40 $0.79 07/01/08 $3.40 $0.79 Non curbside collection means the collection truck or an employee has to physically leave the public right-of-way to collect the waste, recyclables or green waste. Application of this surcharge shall be based on the following off-street collection guidelines: (I) Potential Damage to Property or Equipment: For properties that are very difficult to reach or properties where a truck or property could be damaged during collection, the City may require that the owner bring the waste, recyclable or green waste carts to the street in lieu of charging an additional surcharge. As an option, the City may use smaller, less efficient trucks, subject to payment of the non curbside collection surcharge. (2) Open Areas: When collecting refuse, recyclables or green waste from private property, the City shall not collect within secured residential or commercial yards, within buildings nor outside of parking lots for businesses or apartments. All refuse, recyclables and green waste will be collected from areas accessible from the street without going through a door or gate, except for exempt (disabled, handicapped, frail, or elderly) customers on the Community Assistance Program. (3) Lots Not Requiring an Off-Street (Non Curbside) Collection Surcharge: Lots that front a public street or easement, where waste is collected adjacent to the street or easement by an automated, side-load, collection vehicle. Lots on private roads, where there area enough customers to justify sending an automated, side-load collection vehicle down the road to collect waste in front of each lot or at a common collection point on the road where the collection vehicle can safely turn around. For the purpose of this section, the City will treat a private easement or road, serving four or more houses, as a public street, as long as it is all-weather passable and does not put equipment or property at risk, and the driver or vehicle does not have to leave the easement to collect waste. Lots where wheeled waste carts are placed along a public alley and where an automated, side-load collection vehicle can safely pass without having to turn around or back out. Lots or spaces in planned development or Mobile Home Park, where there is a paved access and where an automated, side-load collection vehicle can safely collect bags or wheeled waste carts in front of each residence or business. (4) Lots Reauiring an Off-Street Collection Surcharge: Lots where wheeled waste carts are not placed adjacent to a public street or easement for collection and where a smaller collection vehicle must leave a public right of way to collect wheeled waste carts at residences or businesses. Lots where smaller collection vehicles must be used to access private driveways or properties to collect waste, and the driver must get out of the vehicle to load the waste. Lots on unimproved easements that are in such a state of disrepair that an automated, side-load collection vehicle cannot safely pass without damaging the vehicle, trees, property or the easement. Lots where access by an automated, side-load collection vehicle is prevented due to: . Excessive pot holes. . Steepness of grade. . Having to ford a stream. . Sub-standard bridge across a creek. . More than one-quarter mile or 1,000 feet from a public road or easement. . Narrowness of road. . Not being able to turn around and having to back up more than 100 feet. (5) Communitv Assistance Program: Residential customers who are disabled, handicapped, elderly or too frail to move a wheeled waste cart to the street, may apply for an exemption from the non curbside collection surcharge and have the drivers move the wheeled waste carts to the street and back. Applying for this special service incorporates granting permission for a driver to go onto the property to move the carts. The Solid Waste Utility shall develop forms and procedures for these requests and to verify qualifications for exemptions. Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 5 of 23 . . D. Assignment or Cart & Container Types & Sizes. Carts and Containers shall be assigned, based on the volume of waste to be collected each week. Where waste from a property routinely exceeds cart or container capacity, the Solid Waste Utility may require the property owner to do one or more of the following: . Upgrade to a container. . Upgrade to a larger waste cart, add additional carts, or upgrade to a container. . Have additional collections per week. Generally, containers shall be provided using the following guide: . Wheeled Waste Cart - Single-family residences, duplexes, individual mobile homes in a Mobile Home Park, small offices or small businesses. These will be used for waste, green waste or recyclables associated with these uses. . Container - Apartment complex with four (4) or more units, business, industry, public agency, Mobile Home Park without individual unit collection, and other locations with sufficient volume. This is generally not for use for construction debris, sheet rock, tile roofing materials, etc. . Drop-box -Industry, construction and other high-volume waste generators. . Trash Compactor - Furnished by the customer. . Wheeled Recvclables Cart - Single-family residence, duplex, individual mobile home, small office, or small business where appropriate for the volume. Wheeled recyclables carts maybe taken away from a customer if contaminated with unacceptable materials (plastic bags, film plastic, shredded paper, hazardous waste, green waste, trash, or other contaminants) after two warnings. A customer must wait a minimum of three months to request the return of a recyclables cart after the first time the cart has been removed for repeated contaminations. Repeat contaminations after such time will result in permanent removal of the cart. . Wheeled Green Waste Cart - Single-family residence, duplex, individual mobile home in a Mobile Home Park, small office, or small business where appropriate for the volume and where enough green waste is generated. Wheeled green waste carts may be taken away from the customer if contaminated with non-green waste (plastic bags, items longer than 3.5 feet in length, palm fronds, pampas grass, star thistle, cactus, poison oak, dirt, rock, concrete, asphalt, painted/treated wood, trash, food scraps, animal manure, recyclables, hazardous materials, metals, or other contaminants) after two warnings. A customer must wait a minimum of three months to request the return of a green waste cart(s) after the first time the cart(s) has/have been removed for repeated contaminations. Repeat contaminations after such time will result in permanent removal ofthe cart(s). Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 6 of 23 . . E. Benton Landfill Postclosure Monitoring Surcharge. The monthly Benton Landfill Postclosure Monitoring Surcharge shall be as follows, based on the type of container collected: WHEELED WASTE CARTS Benton Landfill Postclosure Monitoring Surcharge 07/01/06 $0.22 07/01/07 $0.22 07/01/08 $0.22 OTHER CONTAINERS Benton Landfill Postclosure Monitoring Surcharge 07/01/06 1.36% 07/01/07 1.36% 07/01/08 1.36% The Benton Landfill Postclosure Monitoring Surcharge shall continue until such time as the State waives monitoring requirements for the landfill. This surcharge is in addition to any regular, monthly or container collection rates. F. Tenant Billing. Effective January I, 200, the City shall issue only one bill per container. It shall be the responsibility of each landlord to collect the cost of any solid waste services from tenants who share a waste container. Upon approval of the City, a master tenant may act as the property owner's agent, for bill payment. If a master tenant leaves the property, the solid waste charges shall become the responsibility of the landlord, once the tenant has vacated the property. G. Cost of Recyclables Collection. The cost of recyclables collection shall be included in the basic waste collection charge fro residential and nonresidential properties. Materials that do not fall within the City's recyclables program shall be treated as waste. The City will provide carts or containers for its recycling programs. H. Green Waste Collection. For single-family residences and duplexes, the City will provide green waste collection of up to two (2) 96-gallon wheeled green waste carts per week. The cost of collecting green waste shall be included in the monthly waste charge for residential customers. The City provides wheeled green waste carts for green waste. The maximum weight of any collected cart shall be two hundred (200) pounds. The maximum length of any bundle of branches or limbs shall fit within the waste cart when the lid is tightly closed. As part of its green waste collection program, the City shall also collect Christmas trees and Fall leaves as follows: (I) Leaves - Leaves may be disposed of by placing them in wheeled green waste carts that are collected weekly. For excess leaves during the months of November through January, City residents may bring leaves to the Solid Waste Transfer/Recycling Facility at no charge, and they must bring a current City utility bill and personal identification to prove that they are City residents. (2) Christmas Trees - From December 26 through January 31 of each year, the City will collect Christmas trees that have not been flocked or treated and from which all decorations and stands have been removed, provided such trees have been cut into lengths not exceeding four (4) feet. From December 26 through January 31, City of Redding residents may bring one Christmas tree (with no flocking, tinsel, decorations, or stand) to the Solid Waste Transfer/Recycling Facility at no charge, and they must bring a current City of Redding utility bill and personal identification to prove that they are City residents Trees that are flocked cannot be composted and will be charged as trash. I. Container Collection Rates. (2) Multiple Collections Per Week Per Container: Each additional collection per week shall be charged the same as the charge for one regular collection per week. (3) Special Collection Container Service: Container collections, scheduled on a regular basis, requiring extra collections in a week, shall be charged a fee twenty-five percent (25%) above the weekly collection rate as shown in the following table: Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 8 of 23 . . Permanent container billing status shall apply. Once a container is converted to permanent status, no less than one monthly collection rate charge will apply for billing purposes, even if the container is removed in less than one complete month or billing cycle. (6) Re-deliverv of Temporarv Containers: Once a temporary container is removed, the customer shall wait a period of ninety (90) days before being eligible to receive another temporary container. This also applies to temporary containers that were converted to permanent containers by the Solid Waste Utility. (7) Emergencv/Overtime Fee: Customers needing emergency service that would require overtime will pay an overtime fee that will be established, considering the overtime rate to be paid to the employee and equipment costs. This fee is in addition to the regular fee for the container. (8) Unable to Collect Fee: When an additional collection trip is necessary due to over- filling, prohibited items, or inaccessibility, the customer shall pay an additional charge equivalent to either the temporary or permanent container special pick up fee, which ever is applicable, for the corresponding container size, which is in effect at the time the return Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 9 of 23 . . trip is requested. If subsequent additional collection trips are scheduled, and the customer has not taken action to correct the over loading, to remove the prohibited item, or to mitigate the inaccessibility, the customer shall pay subsequent charges, equivalent to the applicable special pick up fees, for the corresponding container size, which are in effect at the time of each additional trip. These charges shall be in addition to any other costs, including disposal. (9) Charge for Replacement of Containers: The Solid Waste Utility reserves the right to charge the customer for the replacement cost of lost, stolen, damaged or destroyed containers. J. Drop-Box Collection Rates. All permanent drop boxes are subject to no less than one monthly charge, as shown above. (3) Temporarv Drop-boxes: Drop-boxes that are not assigned on a permanent basis shall be billed at the same rate as shown above for each collection that occurs. Temporary status is to be assigned to drop-boxes that are not for ongoing solid waste services at an established premise and which are for short-term or transient usage only. Drop boxes used for construction, remodeling and demolition are, by their very nature, temporary. (4) Extended Time: In the event that a temporary drop-box is not collected by the City within two weeks of its delivery to the property, one collection charge shall be assessed. For each additional day after the first fourteen (14) days that the drop-box is not collected, a daily charge, equal to 1I14th ofthe applicable collection fee, shall be assessed until such time as the City removes the drop-box from the property. (5) Over Loaded Drop-Boxes: Drop-boxes, whose weight exceeds the following schedule, shall be assessed a penalty of: $62.00 per ton effective July I, 2006; $64.00 per ton effective July 1, 2007, and $66.00 per ton effective July 1, 2008. The following table lists the maximum weights for different sized drop-boxes: DROP-BOX SIZE 10 Cubic Yards 16 Cubic Yards 20 Cubic Yards 25 Cubic Yards 30 Cubic Yards 40 Cubic Yards MAXIMUM WEIGHT 1.50 Tons 1.75 Tons 2.50 Tons 3.00 Tons 3.50 Tons 4.50 Tons (6) Unable to Collect Fee: When the Solid Waste Utility is unable to service the drop-box due to one or more of the following conditions: overfilling/overweight, contents that will tear or poke through the cover tarp, or inaccessibility, the customer shall pay an additional charge of: $58.10 effective July I, 2006; $59.85 effective July 1,2007; and $61.65 effective July 1, 2008. If an additional collection trip is scheduled, and the customer has not taken action to correct the problem(s) the customer shall pay an additional charge of: $58.10 effective July 1, 2006; $59.85 effective July 1, 2007; and $61.65 effective July 1, 2008. This charge shall be in addition to any other fees, including disposal. (7) Re-Iocation Fee: Customers needing a drop-box re-Iocated, but not emptied, will be charged a re-Iocation fee, which is equivalent to the Unable to Collect Fee, described in (6), above. (8) Emergencv/Overtime Fees: Customers needing emergency or after hours service requiring overtime will pay an overtime fee that will be established, considering the overtime rate to be paid to the employee and equipment costs. This fee is in addition to the regular fee for the drop-box. (9) Charge for Replacement of Drop Boxes: The Solid Waste Utility reserves the right to charge the customer for the replacement oflost, stolen, damaged or destroyed drop boxes. (10) Prohibited Materials: Drop-boxes containing prohibited items and materials shall not be emptied if the prohibited items are identified. The customer will be charged an Unable to Collect Fee, as described in (6), above. On the occasion that the prohibited items were not identified prior to transport of the drop-box to the solid waste facility, the Solid Waste Utility reserves the right to re-deliver the prohibited item(s) to the customer, whenever feasible, and to charge the applicable labor, fuel and vehicle costs. If the prohibited items are not re-delivered to the customer, but rather are removed by the Solid Waste Utility, the customer will be notified and requested to take possession of the items for proper disposal. In such circumstance, the customer will be charged for applicable labor costs. If the customer refuses to take possession of the items, the Solid Waste Utility will process/dispose/recycle the prohibited items to ensure proper disposal. In such circumstance, the customer will be charged applicable labor, processing, and disposal costs. Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 11 of23 . . The purpose of this policy is to prevent prohibited items, such as hazardous waste, appliances, electronics and other substances which are banned from being landfilled in California, from entering the R.W. Curry West Central Landfill and to compensate the Solid Waste Utility for the management thereof. (ll)Wood Waste Drop Boxes: Drop boxes may be provided, free-of-charge, by the Solid Waste Utility as a courtesy to customers who generate large quantities of clean, un- painted, un-treated wood waste that can be processed at the City's compost facility. Wood waste drop boxes are available to customers who meet the criteria, for a period not to exceed five business days from the time of delivery to the time of removal. Customers whose wood waste drop boxes are found to be contaminated with unacceptable materials will be charged a rate equivalent to the disposal rate for the same size drop box. (l2) Recvcling Drop Boxes: Drop boxes may be provided, free-of-charge, by the Solid Waste Utility as a courtesy to customers who generate large quantities of recyclable materials such as cardboard, newspaper and office paper. Recycling drop boxes must be emptied at least once every two weeks. Recycling drop boxes are available to customers who meet these criteria. Customers whose recycling drop boxes are found to be contaminated with non-recyclable materials when emptied will be charged a rate equivalent to the disposal rate for the same size drop box. K. Large Trash Compactors Collection Rates. . (6) Asphalt. Concrete. Dirt. Large Tree Stumps. and Rocks: Asphalt, concrete dirt, and rocks shall not be accepted at the Transfer Station nor placed in any waste receptacle (carts, containers, drop-boxes or compactors). Such materials shall be taken to an appropriate landfill or other processing facility. Tree stumps over thirty (30) inches in diameter or with dirt and root balls shall be treated as waste. (7) Toxic or Hazardous Materials: No toxic nor hazardous materials shall be accepted from customers at the Transfer Station, except that residential customers only may use the Household Hazardous Waste Facility to dispose of residentially-generated household hazardous waste. Further, toxic and hazardous materials may not be placed in any waste receptacle (carts, containers, drop-boxes or compactors). Solid Waste Utility staff will conduct random load checks of incoming residential, commercial, and industrial loads at both the Transfer Station and the R.W. Curry West Central Landfill. Hazardous materials found during load checks will be returned to the customer for proper disposal. (8) Option to Weight Trash: In lieu of using one of the self-hauled waste or green waste schedules above, the Solid Waste Utility may choose to weight a load of trash. If the load is suspected to weigh more than the cost covered by the volume charge, the load shall be weighed and charged according to weight. Every month, the Solid Waste Utility shall review the City's cost to dispose of scrap metals and shall adjust the fee from $0 to a maximum of $5.00 in order to make up the difference between the City's cost and what it receives from the sale of scrap metals. This shall be based on a $0 fee if the City is obtaining at least $20 per ton for scrap metals and shall be based on a fee of $5.00 if the City is paying $20 per ton to recycle scrap metals. Examples of scrap metal items include, but are not limited to: ovens, stoves, refrigerators, freezers, washers, dryers, dishwashers, water heaters, and equivalent sized business machines or equipment. a) Large Scrap Metal Loads: Large loads of scrap metals shall be charged a special handling fee as follows: WEIGHT o - 200 Pounds 201 - 400 Pounds 401 - 600 Pounds 601 - 800 Pounds HANDLING FEE $5.00 $8.00 $11.00 $14.00 Scrap metal loads in excess of 800 pounds, automobile or truck bodies and frames, vehicle engines, and equivalent items shall not be accepted. b) StJecial Handling Charge to Recvcle Scrap Electronics and Cathode Ray Tubes; A special handling fee to recycle the scrap electronic items listed below shall be charged by the Solid Waste Utility, based on costs to collect, haul and recycle these Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 17 of 23 . . materials. Any costs by a selected processor will be passed on to customers bringing in these materials. Any item which has no cost shall be free to customers. These fees shall be adjusted as bids are received to purchase or haul away such materials for recycling. The Solid Waste Utility shall adjust the fees, based on the most recent bid. The basis for the fees will be one-half of the total cost to collect, process and dispose or recycle the scrap electronics. The City accepts scrap electronics from residential and commercial customers. Examples of scrap electronics are: Computer hard drives, computer peripherals (mouse, keyboard, printer), computer monitors, televisions, consumer electronics (telephones, cell phones, answering machines, pagers, VCRs, radios, stereos, Walkman, CD players) and office equipment (i.e., calculators, copiers, fax machines). (12)Animal Carcasses: Animal carcasses shall not be placed in waste receptacles (carts, containers, drop-boxes, compactors), nor shall they be accepted at the Transfer Station. Animal carcasses may be accepted at the R.W. Curry West Central Landfill by special arrangement. (13)Duplicate Receipt Fees: In the event that a customer or hislher agent receives a receipt for a transaction at the Transfer Station or the landfill, and the customer or hislher agent requests a duplicate receipt, the Solid Waste Utility shall charge a fee of $2 for the duplicate receipt and mailing/faxing of such duplicate receipt. (14) Requirement for Covered Loads: Effective July I, 2004, all loads of waste and green waste brought to the City of Redding Transfer Station and other disposal sites where the City provides waste service shall be covered with a tarp or other device to prevent litter and waste from blowing off the load onto streets, roads, freeways and property adjoining within the City. Excluded from this requirement will be loads that consist solely of the following: . Waste that is contained within a fully enclosed vehicle or trailer that is not open on one or more sides. . Waste that is secured within a trailer or truck or within containers with a secured lid, . Waste that is contained within a sealed bag of plastic or canvas, . Waste that is too heavy to blow off, such as metal, televisions, couches, refrigerators, freezers, washers and dryers, heavy wooden timbers, dressers with drawers secured, and similar items. To be excluded from the covered load requirement, the item must weigh more than five pounds and be tied down or anchored with ropes or straps. Upon entering the Transfer Station or other disposal site, the load shall be untarped prior to going through the scale house in order to verify what the load contains and the applicable charge. (15) Fees for Uncovered Loads: Effective July 1, 2004, the fee for an uncovered load in an open trailer or open truck or pickup bed shall be twice the posted rate for a load that is covered. This fee shall be collected prior to disposal. In lieu of paying the penalty rate, the customer may purchase a tarp at the Transfer Station in a size sufficient to have covered the load. The cost of the tarp will be the Solid Waste Utility's cost to purchase the tarp, plus a ten percent handling charge. Customers that do not pay the penalty fee or purchase a tarp for an uncovered load will be refused service at the Transfer Station or other City disposal site after July 1, 2004. M. Compost Sales & Pricing. (1) Retail Sales: The Solid Waste Utility shall sell any compost it produces directly to customers for not less than the average retail price of three local, retail outlets that sell equivalent compost. Each May, the Solid Waste Utility shall conduct a survey to establish the price. If there is not comparable compost in the market, the Solid Waste Utility shall set the price, based on a reasonable cost recovery and to minimize the amount of grass to be buried at the landfill. A discount of up to fifteen percent (15%) may be provided for purchases in excess of four (4) cubic yards. (2) Wholesale Sales of Compost: The Solid Waste Utility may sell compost on a wholesale basis to retail businesses at eighty percent (80%) of the City's posted retail price. (3) Wood Chip Sales: The Solid Waste Utility may sell wood chips to the public, nonprofit organizations, public agencies, or on a wholesale basis, following the same formula by which it sells compost. The price for wood chips shall be established on an annual basis by the Solid Waste Utility. (4) Unscreened Mulch Sales: The Solid Waste Utility may sell unscreened mulch to the public, nonprofit organizations, public agencies, or on a wholesale basis, following the same formula by which it sells compost. The price for unscreened mulch shall be established at $1 per cubic yard less than the price for screened compost. (5) Sales to Nonprofit Organizations and Public Agencies: The Solid Waste Utility may sell compost or wood chips to nonprofit organizations and public agencies, doing landscape or beautification projects in the City, at the City's wholesale price. (6) Compost. Unscreened Mulch & Wood Chips Deliverv Costs: If the buyer of compost or wood chips does not provide transportation, the City may haul compost, based on the actual cost, plus ten percent (10%) to any location within the City or within five (5) miles of the Transfer Station, whichever is further. The minimum load to be hauled by the City shall be five (5) tons or ten (10) cubic yards. If a driver or vehicle is not available, the City may decline to provide this service. When special services are not covered by adopted fees, or charges are required, the Solid Waste Utility shall charge actual costs, including labor, overhead, fuel, equipment, tipping fees, and other charges to the Utility. (I) Residential Special Collection Program for Hard-to-Handle Items: This program is to be charged at actual cost. The rate is based on the round trip distance involved, assuming an average trip of four miles or less, using combined pickups. The program operates as a same day service for items called in during the morning and as a next day service for items called in during the afternoon. The maximum number of items to be picked up in one trip is six (6) items. The Transfer Station disposal cost is added to the cost of each item picked up, as outlined in Section L of this Policy. This special residential pick up program is available only to residents of the City of Redding and is not for general waste, green waste or recyclables intended to be placed in waste containers, nor is it to be used for household hazardous waste. It is only for large, hard to handle items that would otherwise be taken to or accepted at the Transfer Station for disposal. Items to be picked up shall be placed within six (6) feet of the curb, so they can be loaded onto the collection vehicle. If placed in a driveway, beyond six (6) fee from the street, the owner waives any damage claims to the driveway from the weight of the collection vehicle, or if an item is dropped while being collected. In no case shall an employee go into a residence, into a garage or into any other yard area to pick up items. The maximum size, volume or weight of anyone item shall not exceed eight (8) feet in length, nor exceed 1,000 pounds. (2) Fees to be Adiusted Annuallv: The fees outlined above shall be adjusted annually, after adoption of the City's budget, to reflect current costs. Amended Solid Waste Rate Schedule & Service Policies 12-18-07 Page 20 of 23 . . O. Collection of Waste Creating a Public Health & Safety Hazard on Private Property. If the Solid Waste Utility collects, transports, and buries waste, collected from private property, to remove a public health and safety hazard or as part of an abatement process in addition to any required service rate, such service shall be charged to the property owner at the appropriate, posted rate. If there is not an applicable service rate, the charge shall be the actual cost, based on the weight of the materials removed, labor, equipment, and the type of container used to haul the waste material. If not paid within thirty (3) days of billing, it shall constitute a lien of the property. . P. Rounding Off Fees. When setting fees for Transfer Station sales or charges, the Solid Waste Utility may round off to the nearest $0.25 in order to reduce change making at the scale houses. Q. Requirement for Pre-Payment. (1) New Accounts: New accounts will be required to prepay the estimated average aggregate bill for two months' service, but not less than $50 for residential accounts and not less than $100 for commercial accounts. The pre-payment will be waived for a commercial account operating a like business within the previous 18 months, if one of the following occurs: a. The customer of record presents a valid letter of credit from another utility. b. The customer of record has previously established and maintained a good credit history with Redding's utilities for a like business. c. The customer of record authorizes the City to run a credit report, and the score is 800 or higher for commercial accounts, via Equifax or any other credit reporting agency with which the City has contracted, and customer agrees to pay a subsequent fee to reimburse the City for the cost of the report. (2) Existing Accounts: Existing accounts will be required to pre-pay the estimated average aggregate bill for two months' service, but not less than $50 for residential accounts and not less than $100 for commercial accounts, if one of the following occurs: a. The Utility account is turned off for nonpayment of account, in which case, the customer will be required to satisfy the terms of pre-payment, and to pay all fees and penalties assessed, and the entire delinquent balance. b. The Utility account has been delinquent more than once in the last twelve months. (For this purpose, an account will be considered delinquent when a Final Notice has been sent.) d. The customer's utility credit rating has declined to the point that the Director of Municipal Utilities determines that it is in the best interest of the Utility to require pre-payment when re-establishing service. Requirement to Bring Account Current Prior to extending new or additional services, the Solid Waste Utility reserves the right to require the customer bring any delinquent account balances, including fees, current.
