Code §6103 A.P.N. 110-150-022 None Recorded Official Records CRIS I~iDREI~S Recorder, 10:~3gt~ 13-Dec-L~ REC FEE Page I of ~ RESOLUTION NO. 2002- ! 7 / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING SUMMARILY VACATING THAT PORTION OF THE 20' PUBLIC SERVICE EASEMENT DESCRIBED IN THE EASEMENT GRANTED TO THE CITY OF REDDING~RECORDED IN THE OFFICE OF THE SHASTA COUNTY RECORDER ON OCTOBER 15, 1990, IN BOOK 2652 AT PAGE 276 LYING WITHIN THE BOUNDARIES OF OAK MEADOWS ESTATES SUBDIVISION NO. S-2-91 (A-12-01). WHEREAS: A. A 20' public service easement was granted to the City of Redding by Easement dated January 8, 1990, and recorded October 15, 1990, as Document No. 45040, in Book 2652 at page 276, Shasta County Records ("the Easement"). B. That part of the Easement lying within the boundaries of Oak Meadows Estates Subdivision S-2-91, recorded in Book 22 of Maps at page 90, Shasta County Records (the "Area of Vacation"), has been superseded by relocation, and the Engineering Division of the Development Services Department has advised the City Council that there are no in-place public utility facilities that are in use or would be affected by the proposed vacation. C. The owner of the parcels known as 3895 Meadow Oak Way, 4038 Saffron Way and 4015 Saffron Way has asked that the City vacate that portion of the Easement located within the Area of Vacation, as more particularly described in Exhibit A and shown crosshatched on Exhibit B attached and made a part hereof by reference. NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: The City Council elects to proceed in this matter under the provisions of the Public Streets, Highways and Service Easements Vacation Law as set forth in Section 8333, et seq., of the Streets and Highways Code of the State of California. The City Council approves the request to summarily vacate that portion of the 20' public service easement described in the Easement granted to the City of Redding--recorded in the Office of the Shasta County Recorder on October 15, 1990, in Book 2652 at page 276 lying within the boundaries of Oak Meadows Estates Subdivision No. S-2-91 recorded in Book 22 of Maps at page 90, Shasta County Records, as more particularly described in Exhibit A and shown crosshatched on Exhibit B attached hereto ("Area of Vacation"). The 20' public service easement located within said Area of Vacation has been superseded by relocation, and there are no other public facilities located therein. In fact, the easement has not been used for the purpose for which it was dedicated or acquired for more than five consecutive years immediately preceding this vacation. Therefore, from and after the date this resolution is recorded, the 20' public service easement located within the Area of Vacation shall be vacated in its entirety and shall no longer constitute an easement for public service purposes. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested by the Clerk under seal, to be recorded in the office of the Shasta County Assessor/Recorder.
