HomeMy WebLinkAboutReso 2002-158 - Lanning AvenueRESOLUTION NO. 2002- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REAL ESTATE PURCHASE AND SALE AGREEMENT BY AND BETWEEN THE REDDING REDEVELOPMENT AGENCY AND JERRY AND JENNIFER HAGGARD AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH WHEREAS, the Redding Redevelopment Agency is engaged in activities necessary to execute and implement the Redevelopment Plan for the Market Street Redevelopment Project Area; and WHEREAS, in furtherance of the objectives of the Califomia Community Redevelopment Law (Califomia Health and Safety Code Section 33000 et seq.), the Agency has undertaken the Leland/Junior Residential Project to revitalize the Parkview Neighborhood; and WHEREAS, the Implementation Plan adopted by the Agency with respect to the Redevelopment Plan includes neighborhood improvement and affordable housing activities; and WHEREAS, the Agency acquired property owned by Jerry and Jennifer Haggard located at 2907 Lanning Avenue to facilitate the Lelancl,/Junior Residential Project; and WHEREAS, the Agency has a statutory obligation to assist in the relocation of persons and families displaced as a result of the Leland/Junior Residential Project; and WHEREAS, Jerry and Jennifer Haggard are persons or families of low or moderate income as defined by Section 50093 of the California Health and Safety Code; and WHEREAS, Jerry and Jennifer Haggard desire to purchase property owned by the Agency located at 545 Parkview Avenue (Property) for use as their private residence; and WHEREAS, it has been determined that the Property is not needed for neighborhood revitalization purposes; and WHEREAS, the Agency and the Haggards propose to enter into a Real Estate Purchase and Sale Agreement; and WHEREAS, pursuant to Section 33433 of the Community Redevelopment Law, the Agency is authorized, with the majority approval of the City Council after a public hearing, to convey property for redevelopment purposes pursuant to the Redevelopment Plan upon a determination by the City Council that the sale of the property will provide housing for low- or moderate-income persons and that the consideration for such sale is not less than either the fair market value of the fair reuse value in accordance with the covenants and conditions goveming the sale and development costs thereof; and WHEREAS, a joint public hearing of the Agency and City Council on the proposed Agreement was duly noticed in accordance with requirements of Health and Safety Code Section 33433; and WHEREAS, the proposed Agreement and a summary report meeting the requirements of Health and Safety Code Section 33433 were available for public inspection consistent with the requirements of Health and Safety Code Section 33433; and WHEREAS, on November 5, 2002, the Agency and City Council held a joint public hearing on the proposed Agreement and evaluated all of the information, testimony, and evidence presented during the joint public heating; and WHEREAS, the City Council has reviewed the summary report required pursuant to Health and Safety Code Section 33433 and evaluated other information provided to it pertaining to the findings required pursuant to Section 33433; and WHEREAS, the sale of the property pursuant to the proposed Agreement will provide housing for a low and moderate-income family; and WHEREAS, the value of the consideration for the property pursuant to the proposed Agreement will not be less than the fair market value of the site as set forth in the Summary Report; and WHEREAS, the City of Redding Development Services Director has determined that the sale of the property for residential purposes is consistent with the Redding General Plan; and WHEREAS, the sale of surplus government property is categorically exempt under Section 15312 of the California Environmental Quality Act; and WHEREAS, the City Council has duly considered all terms and conditions of the proposed Agreement and believes that the disposition of the Site pursuant thereto is in the best interests of the City of Redding and the health, safety, and welfare of its residents, and in accord with the public purposes and provision of applicable state and local laws and requirements. NOW, THEREFORE, the City Council of the City of Redding FINDS, RESOLVES AND ORDERS as follows: 1. The above recitals are true and correct. Page 2 The City Council of the City of Redding makes the following findings in connection with the proposed Real Estate Purchase and Sale Agreement: (a) The sale of the property at 545 Parkview Avenue will provide housing for low- or moderate-income persons and is consistent with the implementation plan adopted pursuant to Section 33490 of the California Health and Safety Code; and (b) The consideration is not less than the fair market value in accordance with the highest and best use under the Redevelopment Plan. 3. The City Council of the City of Redding hereby approves the sale of the Property. I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted by a majority vote at a regular meeting of the City Council of the City of Redding on the 5th day of November 2002.
