RESOLUTION NO. 2007 - 219
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY V ACA TING A PORTION OF PUBLIC SERVICE EASEMENT
"E" SHOWN ON THE MAP OF ALDER CREEK SUBDIVISION (FORMERLY
HACIENDA HEIGHTS) UNIT 8, RECORDED AUGUST 17, 2004, IN BOOK 23
OF MAPS AT PAGE 52, SHASTA COUNTY RECORDS (2594 WARM
SPRING LANE; A-3-07).
WHEREAS:
A. This portion of Public Service Easement "E" was dedicated to the City of Redding
on the Alder Creek Subdivision (formerly Hacienda Heights), Unit 8, recorded August 17, 2004,
in Book 23 of Maps at Page 52, Shasta County Records (hereafter called the Easement).
B. The owners of the property have asked that the City vacate the Easement, described
in Exhibit A and shown hatched on Exhibit B, attached and made a part hereof by reference, as it
has not been used for the purpose for which it was dedicated or acquired..
C. The Engineering Division of the Transportation and Engineering Department has
advised the City Council that there are no in-place public utility facilities that are in use or would
be affected by the proposed vacation and that the Easement, described in Exhibit A and shown
hatched on Exhibit B, is not required for public use.
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES AND
ORDERS AS FOLLOWS:
I. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2.
The City Council approves the request to summarily vacate this portion of Public Service
Easement "E" dedicated to the City of Redding on the Alder Creek Subdivision (formerly
Hacienda Heights), Unit 8, recorded August 17, 2004, in Book 23 of Maps at Page 52,
Shasta County Records, described in Exhibit A and shown hatched on Exhibit B.

3. The date of dedication or acquisition of the "Easement" is less than five years, and more
than one year, immediately preceding this proposed vacation; the easement has never
been used for the purpose for which it was dedicated or acquired; it is not needed for the
purposes for which it was dedicated; it is not required; and there are no public facilities
located therein. Therefore, from and after the date this resolution is recorded, the portion
of Public Service Easement "E," described in Exhibit A and shown hatched on Exhibit B,
shall be vacated in its entirety and no longer constitute an easement for public service
purposes.
4. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
Assessor/Recorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read and adopted at
a regular meeting of the City Council on the 4th day of December, 2007, by the following vote:

All that portion of the existing PSE per the map of Alder Creek (formerly known as
Hacienda Heights) Subdivision No. S-5-98 Unit 9, filed for record February 24,2005 in
Book 23 of Maps at page 66 (23 M 66) within Adjusted Lot 2 as shown on the PLA #15-
05, Recorded June 23, 2005 as Doc. No. 2005-0035216 Shasta County Records (PLA
# 15-05), more particularly describe as follows:
COMMENCING at the Northeast comer of Adjusted Lot 2 as shown on said (PLA #15-
05); thence North 89038'24" West along the North line of Adjusted Lot 2 a distance of
6025 feet to the TRUE POINT OF BEGINNING; thence continuing North 89038'24"
