HomeMy WebLinkAboutReso 2007-203 - St. Andrews Drive . . . RESOLUTION NO. 2007 - 203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING DECLARING A STRIP OF LAND ALONG THE SOUTHERLY EDGE OF ST. ANDREWS DRIVE AS SURPLUS PROPERTY AND APPROVING THE DISPOSITION OF SAID PROPERTY WHEREAS, the City acquired fee title without restriction to a strip ofland approximately 30 feet wide and 520 feet long located along the southerly edge ofthe 1400 block of St. Andrews Drive as part of the Gold Hills subdivision, as described in Exhibit A hereto (the "Property"); and WHEREAS, each City department was consul ted and no current or future municipal use was identified; and WHEREAS, Section 54222 of the Government Code requires that the City, prior to disposing of surplus land, send to public entities a written offer to sell or lease the property as follows: for the purpose of developing low- and moderate-income housing; for park and recreational or open space purposes; for school facilities construction if the land is so suitable; for enterprise zone purposes if the land is located within a designated enterprise zone; or for the purpose of development within a designated infill opportunity zone established pursuant to Section 65088.4 of the Government Code; and WHEREAS, due to its dimensions and shape, the Property is incapable of independent development and use for any purpose specified in Government Code Section 54222; and WHEREAS, from a land use perspective, the most logical use for the Property is for it to be consolidated with one or more irnmediately adjacent parcels. NOW, THEREFORE, the City Council FINDS, RESOLVES, and ORDERS as follows: 1. The above recitals are true and correct. 2. The Property is hereby declared surplus. 3. Sale of the Property by the City is categorically exempt from the requirements ofthe California Environmental Quality Act (CEQA) pursuant to Section 15312 of the CEQA Guidelines (Surplus Government Property Sales). 4. Due to the fact that the Property is incapable of being developed independently or used for any purpose specified in Government Code Section 54222, it is not necessary for the City to offer the Property for sale or lease as required by Government Code Section 54222. 5. The City Manager is authorized to negotiate the sale of the property to the record owners oftheparcels located immediately adjacent to the Property: Assessor's Parcel Numbers 073-180-003, -004, and -019. ~ ~ lAJ . . 6. The Mayor is authorized to execute grant deeds conveying the Property to the adjacent owners and to execute such other documents as may reasonably be necessary to effectuate the transfer of title.
