RESOLUTION NO: 2007 - 174
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
SUMMARILY VACATING A PORTION OF WAUSHARA AVENUE
STREET RIGHT-OF-WAY LOCATED ACROSS THE REAR OF LOTS AT
1490,1478,1466,1454, AND 1442 JEN WAY (A-5-07)
WHEREAS:
A. The portion being considered for summary vacation was acquired by implied
dedication with the map of the Fern Addition to Woodlawn filed March 3,1888, in Book of Old
Plats at Page 38, Shasta County Records.
B. This portion of street right-of-way has not been used for the purpose for which it
was dedicated or acquired. Therefore, the owner of the property has asked that the City vacate
this portion of street right-of-way, described in Exhibit "A" and shown hatched on Exhibit "B,"
attached and made a part hereof by reference.
C. The Engineering Division of the Transportation and Engineering Department has
advised the City Council that there ARE in place public-utility facilities that are in use or that
would be affected by the proposed vacation; therefore, the City is RETAINING a public-service
easement over the portion of street right-of-way described in Exhibit "A" and shown hatched on
Exhibit "B."
NOW, THEREFORE, THE CITY COUNCIL DETERMINES, RESOLVES, AND
ORDERS AS FOLLOWS:
I. The City Council elects to proceed in this matter under the provisions of the California
Streets and Highways Code, Section 8333.
2. The City Council approves the request to summarily vacate the portion of street right-of-
way described in Exhibit "A" and shown hatched on Exhibit "B."

3.
This portion of street right-of-way has not been used for the purpose for which it was
dedicated or acquired for five consecutive years immediately preceding this vacation.
4. THE CITY RESERVES AND EXCEPTS FROM THE VACATION a public-service easement for
the purpose of erecting, installing, constructing, removing, repairing, replacing,
reconstructing, maintaining, and using for public-service purposes any and all materials,
fixtures, appliances, equipment, pipes, pipelines, wires, and cables (including fiber optics)
necessary for the transmission, distribution, and delivery of electricity, water, sewer,
storm water, gas, cable television, communication, and information service utilities over,
along, upon, under, and across the parcel of real property described in Exhibit "A" and
shown hatched on Exhibit "B"; along with the right to:
a. Grant said easement or a portion thereof to other public utilities or public agencies;
b. Review and control the planting, trimming, maintenance and/or removal of any
trees or other plants within said easement; and
c. Enter upon said easement for the purpose of construction, replacement, maintenance
and repair of any and all public service facilities and appurtenances within said
easement.
5. The City Clerk is directed to cause a certified copy of this resolution of vacation, attested
by the Clerk under seal, to be recorded in the office of the Shasta County
AssessorlRecorder.
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted
at a special meeting of the City Council on the 7th day of August, 2007, by the following vote:

LEGAL DESCRIPTION
All that certain real property situate in the City of Redding, County of Shasta, State of
California, lying within Lots 10-14 as shown on the subdivision map of Lakeside
A venues, recorded as 8-18-03 in book 23 of maps at page 96 Shasta County records (23
M 96) more particularly described as follows:
BEGINNING at the Southwesterly corner of Lot 14 of said (23 M 96) also being the
intersection of the Northeasterly right-of-way of Buena ventura Blvd. and the centerline of
Waushara Avenue as shown on said (23 M 96); thence South 67019'4T' East along the
centerline ofWaushara Avenue a distance of382.22 feet to the Southerly most corner of
Lot 10 of said (23 M 96); thence leaving said centerline North 79016'16" East along the
Southeasterly line of said Lot lOa distance of 72.67 feet; thence leaving said
Southeasterly line, parallel with the centerline ofWaushara Avenue and 40.00 feet distant
