RESOLUTION NO. 2007 - 152
LANDSCAPE MAINTENANCE DISTRICT "K"
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING
(I) CONFIRMING THE MAPS OF THE ASSESSMENT DISTRICT
CONTAINED IN THE ENGINEER'S REPORT.
(2) APPROVING THE ANNUAL ASSESSMENTS FOR FISCAL YEAR
2007-08 PURSUANT TO THE LANDSCAPING AND LIGHTING
ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE
STREETS AND HIGHWAYS CODE AND STAYING THE LEVY
OF THE SAME FOR FISCAL YEAR 2007-08.
WHEREAS:
A, On June 19,2007, by Resolution 2007-105, the City Council approved the Report of the
Engineer as filed relating to Landscape Maintenance District "K" (District) and gave notice
of the time and place ofthe July 3,2007, public hearing regarding the levy and collection of
assessments for Fiscal Year 2007-08.
B. A map of the area in the District is attached and made a part hereof.
C. The public hearing, duly and properly noticed, commenced at the City Council Chambers,
777 Cypress Avenue, Redding, California on July 3,2007, and was concluded prior to the
adoption of this resolution. At the public hearing, the City Council gave every interested
person an opportunity to object to the proposed assessments.
D. The assessment for Fiscal Year 2007-08 is $244.70, which is not an increase within the
meaning of Streets and Highways Code S 22624 and 22630.5, because the cost ofliving
adjustment in the amount of$5.12 is pursuant to a methodology approved at the time of the
formation of the District.
E. All legal prerequisites to the adoption of this resolution have occurred.
THEREFORE THE CITY COUNCIL FINDS, RESOLVES, DETERMINES, AND
ORDERS AS FOLLOWS:
I. The matters set forth above are true and correct.
2. The maps of the assessment district contained in the Engineer's Report are confirmed.
3. The City Council has considered all oral statements and written protests or communications
made or filed by interested persons at the public hearing of July 3, 2007, and expressly
overrules any and all protests filed objecting to the proposed annual assessments and levy
amount in the District.

4. The City Council finds that the Engineer's Report has fairly and properly apportioned the
costs of the improvements to each lot/remaining parcel ofland in the district in proportion
to the estimated benefits to be received by each lot/remaining parcel ofland from the
improvements.
5. An assessment of $244. 70 against each developable lot/remaining parcel located within the
District for Fiscal Year 2007-08 is confirmed and adopted. Notwithstanding the preceding,
said assessment shall not be levied during Fiscal Year 2007-08.
6. The City Clerk shall forthwith transfer to the Auditor Controller and the Assessor Recorder
of Shasta County a certified copy of this resolution and a certified copy of the assessment
district maps contained in the Engineer's Report for Landscape Maintenance District "K."
7. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways
Code Section 22626(a).
I HEREBY CERTIFY that the foregoing resolution was introduced, read, and adopted at a
regular meeting of the City Council on the 3'd day of July, 2007, by the following vote:
