HomeMy WebLinkAboutReso 2007-110 - LMD 03-06 " . e e RESOLUTION NO. 2007-110 LANDSCAPE MAINTENANCE DISTRICT 03-06 (HOPE LANE) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING APPROVING THE REPORT OF THE ENGINEER AS FILED, AND DECLARING ITS INTENTION TO: (1) SET A PUBLIC HEARING DATE RE LANDSCAPE MAINTENANCE DISTRICT 03-06. (2) APPROVE THE ASSESSMENTS IN DISTRICT 03-06 FOR FISCAL YEAR 2007-08 PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, COMMENCING WITH SECTION 22500 OF THE STREETS AND HIGHWAYS CODE AND STAY THE LEVY OF THE SAME FOR FISCAL YEAR 2007-08. WHEREAS: A. The City Council heretofore ordered the consolidated formation of Landscape Maintenance District 03-06 (District) under authority granted by the Landscaping and Lighting Act of 1972, as set forth in Part 2 of Division 15 of the Streets and Highways Code of the State of California. B. The purpose of the District is to provide maintenance to those landscaping improvements required within the public rights-of-way and/or easements by the conditions of development approval of the subdivisions contained therein. C. The Engineer has filed his Report with the City Clerk pursuant to Streets and Highways Code Section 22565, et seq. D. This Resolution is made in satisfaction of those requirements set forth in the Streets and Highways Code Section 22624. E. The assessment for Fiscal Year 2007-08 is not an increase within the meaning of Streets and Highways Code ~22624 and 22630.5 because the cost ofliving adjustment provided for herein was approved at the time of the formation of the District NOW, THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL THAT: 1. The matters set forth above are true, correct, and are adopted herein. 2. Pursuant to the Streets and Highways Code ~22623, the Report of the Engineer, as filed, is hereby approved. 3. The Report of the Engineer, on file with the City Clerk, contains a full and detailed description of the improvements, the boundaries of the District and any zones therein, and the proposed assessments upon the assessable lots and remaining parcels within the District. ~ ~ . 4. The existing improvements for each subdivision in the District are set forth in Part E of the Engineer's Report, on file with the City Clerk, under the column entitled "Improvements." ~ o o 1 - - o ~. . e e 5. The general locations of the lots and remaining parcels in the District are set forth in Part A of the Engineer's Report, on file with the City Clerk. 6. Only costs for the maintenance oflandscaping; miscellaneous lighting; mulching; vandalism; repairs to the irrigation system; electric and water charges; replacement of vegetation as necessary; removal of trimmings, rubbish, and debris; maintenance of the detention basin; and other improvements to remove or cover graffiti, administrative costs, painting of any walls, and such other maintenance and incidental expenses as are authorized by Streets and Highways Code Sections 22526 and 22531, will be assessed. 7. A public hearing will be held on Tuesday, July 3, 2007, at the hour of 7 p.m., or as soon thereafter as the matter may be heard, in the City Council Chambers located at 777 Cypress Avenue, Redding, California, to address the levy of the proposed assessment for Fiscal Year 2007-08. The proposed assessment for Fiscal Year 2007-08 is $369.32, it being the intention ofthe Council to stay levy of said assessment for Fiscal Year 2007-08. 8. The method of calculating the annual assessment is set forth in Part C of the Engineer's Report, on file with the City Clerk, under the column entitled "Assessment District Revenue." 9. That the City Clerk shall give notice of said hearing pursuant to the Streets and Highways Code Section 22626(a).
