HomeMy WebLinkAboutOrdinance - 2386 - Amend Title 16 e e ORDINANCE NO. 2386 AN ORDINANCE AMENDING TITLE 16 (BUILDINGS AND CONSTRUCTION) CHAPTER 16.20 (DEVELOPMENT IMPACT FEES) SECTION 16.20.030.B OF THE CITY OF REDDING MUNICIPAL CODE REGARDING UPDATING OF THE FIRE FACILITIES IMPACT FEE SCHEDULE WHEREAS, pursuant to Chapter 16.20 of the Redding Municipal Code, the City Council ofthe City of Redding may establish development impact fees to assist in the implementation ofthe City of Redding General Plan and to mitigate the impact of development identified in the documents titled "Comprehensive Impact Fee Study for the City of Redding dated May 19, 2000, and the final Environmental Impact Report for the city of Redding general plan; and. WHEREAS, the City has prepared The City of Redding Fire Facilities Update Study, dated January, 2007 ("the Report"), which is incorporated herein by reference, to provide the legal and policy justification for an update to the Fire Facilities Impact Fees to fund a portion of the costs associated with fire facilities to accommodate impacts from future growth; and WHEREAS, the Construction Cost Index published by the Engineering New Record is deemed a reputable and reliable source of information on the inflation of construction costs and may be used periodically as a basis for fee inflation through separate City Council action, NOW, THE~EFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS: Section 1. Title 16, Chapter 6.20, Section 6.20.030.B is hereby amended to read as follows: 16.20.030 Fire facilities impact fee. A. [No Change to subsection A] B. Fee schedule. The Fire Facilities Impact Fee imposed pursuant to this section shall be based on the fee schedule in effect on the date of the fee-payer's application for the appropriate building permit and shall be paid to the City prior to the issuance of a building permit or a permit for mobile- home installation, as follows: 1. Single Family. a. Effective 7/01/07: The fee shall be $361. b. Effective 1/15/08: The fee in effect shall be increased to $588 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. ~ UJ C><) 0\ e e .. c. Effective 1/15/09: The fee in effect shall be increased to $815 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. d. Effective 1/1/10, and on each January 1 thereafter, the fee shall be increased or decreased by any change in the Construction Cost Index as published in the most- recent November Engineering News Record. 2. Multiple Family-- fee is per dwelling unit. a. Effective 7/01/07: The fee shall be $281. b. Effective 1/15/08: The fee in effect shall be increased to $468 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. c. Effective 1/15/09: The fee in effect shall be increased to $655 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. d. Effective 1/1/10, and on each January 1 thereafter, the fee shall be increased or decreased by any change in the Construction Cost Index as published in the most- recent November Engineering News Record. 3. Commercial-- fee is per 1,000 square feet. a. Effective 7/01/07: The fee shall be $241. b. Effective 1/15/08: The fee in effect shall be increased to $403 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. c. Effective 1/15/09: The fee in effect shall be increased to $565 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. d. Effective 1/1/10, and on each January 1 thereafter, the fee shall be increased or decreased by any change in the Construction Cost Index as published in the most- recent November Engineering News Record. 4. Office/general-- fee is per 1,000 square feet. a. Effective 7/01/07: The fee shall be $358. b. Effective 1/15/08: The fee in effect shall be increased to $597 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. 2 e e " c. Effective 1/15/09: The fee in effect shall be increased to $836 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. d. Effective 1/1/1 0, and on each January 1 thereafter, the fee shall be increased or decreased by any cthe Construction Cost Index as published in the most-recent November Engineering News Record. 5. lndustrial-- fee is per 1,000 square feet. a. Effective 7/01/07: The fee shall be $193. b. Effective 1/15108: The fee in effect shall be increased to $322 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. c. Effective 1/15/09: The fee in effect shall be increased to $452 plus or minus any change in the Construction Cost Index as published in the most-recent November Engineering News Record. d. Effective 1/1/10, and on each January 1 thereafter, the fee shall be increased or decreased by any change in the Construction Cost Index as published in the most- recent November Engineering News Record. Section 2. It is hereby found and determined that The City of Redding Fire Facilities Update Study, dated January, 2007 ("the Report"), meets the following requirements: (1) Identifies the purpose ofthe fee. (2) Identifies the use to which the fee is to be put.(3) Determines how there is a reasonable relationship between the fee's use and the type of development project on which the fee is imposed. (4) Determines how there is a reasonable relationship between the need for the public facility and the type of development project on which the fee is imposed and determines how there is a reasonable relationship between the amount ofthe fee and the cost ofthe public facility or portion of the public facility attributable to the development on which the fee is imposed. Section 3. The passage of this ordinance is not a "project" according to the definition in the California Environmental Quality Act, and therefore is not subject to the provisions requiring environmental review. Section 4.
